    Default CCA - I took action and Won BUT HELP

    I have just had a judgement entered against Sanders and Kay Ltd with costs and court fees entered against them for none compliance with my request for a copy of the consumer agreement and for defaulting an account i dispute.

    The twist being EQUIFAX although fully aware of the proceedinf still state the information is correct confirmed by client. Refsue to move it. I have stated that the information is a breach of the DPA. But they won't budge, should i summons them.

    I also have another entry on this credit file showing two deafults for the same compnay and account and amount, yet again they refuse to shift it as one defaults states HP the Other loan and I get electronic response stateing they have confirmed details are correct.

    I only have htese three defaults showing (Although 2 really) Both disputed yet can't budge them .

    Advise on next best action, I Have sent lbaicon and they haven't removed it.

    Drag Equifax into court as well, and force them to comply with your request.

    Don't forget to ask the court for damages:grin:

    I agree with djweeble, drag them into court. If the judgement against you as entered wrongly and you have proven this with the court case, the have a legal obligstion to remove it as it has been proved in court, should they not that can be classed as comtempt of court. IMO
    Would be interesting to see how this progresses eh?

    Friendship costs nothing but its rewards can be priceless. Do not judge, as you will not be judged but if you can, try and assist where possible.

    How did you take action for non compliance for a CCA as it is a criminal offence to be dealt by a magistrates court and not a civil county courticon?

    Wil send one out in the morning(S.A.R - (Subject access requesticon)) as they still conduct business with me and as they have incorrect info the S.A.R - (Subject access requesticon) would make this clear. Then the rest etc.
    I will have to adjust the sar a bit.

    The wording of the CCA, only states an offence. I always thought that this would be a civil offence.
