Plenty of ideas - they ALL roll over in the end, because what they are doing is not legally enforcable.
Abbey will send you a letter saying, "your complaint is being looked at. We will endevour to get back to you within 15 years..." or something like that.
After the 14 day deadline, start action against them - no amount of pleading, threatening etc... will make any difference, so you may as well cut to the chase.
They will acknowledge the claim pretty much after about 10-12 days - right near the knuckle - then, as they now have a further 14 days, they will issue a defence, about 10-12 days later.
The court will send you an allocation questionnaire (and Abbey too). It is at this point that they will get in touch with you and probably offer half - if not they will attempt to scare you off with talk of legal costs etc... (If your claim is under 5k the likelyhood of you being liable for their costs is so very slim).
If you refuse the offer of half they will pay in full.
Otherwise, they may just take it to court - we can only wish.

dave - how do they normally go about contacting you, ie: making the offer, is this something in writing or do they tend to do it by phone ?
Just wondered because if they leave it until the last couple of days then don't they run a risk of not getting hold of you in time ??

That's their probelm. Don't worry about it. Just set your deadlines and stick to them

They usually write. In both of our claims against them, we have waited right up to the last minute to reply; and then said, "due to the time constraints set by the court, I require an answer from you within 5 days, or I shall commence with the court proceedings."

Abbey have not replied to my original letter (demanding my £250 of charges back or else!) which I sent on 23/02/06. Its now 06/03. Should I start legal proceedings or wait a few more days incase they are going to send me a letter saying they will refund the charges?
Pe prepared though - one day, they will decide that enough is enough and will start to fight back - yours could be the one - and, based on my experience of banks, they WILL play dirty.

When I got home yesterday I had a personal reply to my letter about wanting all my charges back! From all the stuff I've read on this forum it was a standard letter saying their back charges wern't unfair and it was my responsibility to keep within my limits blah blah! To add insult to injury they are offering me £50 as a GWG!
Its up to me now I suppose, do I want to take the plunge? Ok what should I do now? They are giving me 8 weeks and if they don't here from me they will assume I've accepted the GWG and will 'close my file'.
If I wanted to take this further is there a template of a letter I can send to them and stay stuff your £50 and I'm taking this further and then go to the claims website you refer to on this forum?!
Abbey offered me a GWG of £50. I gave them 7 days in which to refund this and the other £250 they owe me. 7+ days later this money hasn't gone in. They sent me a letter today saying all the usual BS that thier charges were fair blah blah blah!
They even had the gaul to say they had waived £70 of charges since Jan 06 and these had been refunded to my account! I do not see them anywhere!
Right i'm off to the money claim website to start proceedings!
