Add all charges including the £12 to your total claims because no one has recommended that £12 is a legal requirement. OFT only gave an indicative amount. Subsequent news report on the BBC and investigations revealed that the maximum per transaction could be £4.50 while a minimum could be less than a pound.
I think you should let the court decide between you and the bank. Obviously, since the bank will exit the race at the last minute, you will receive your full refund + statutory interest + court cost.
