    Default Damage sustained in Council car park - are they really not liable?

    I hope someone can help me. I have contract parking with a London car park. A month ago, whilst parked overnight, another car (probably a Chelsea tractor) damaged the from n/s wing of my car causing approx £700 of damage. Despite parking near to a camera, the car park claim that they have examined the cctv footage & cannot see who did it & that they aren't liable for the damage. Can I challenge this on the basis that they advertise as being a safe and secure car park, and that they had a duty of care? Any suggestions are most welcome. Thank you

    Sorry Boysey, every car park I have come accross states they are not liable for damage. The claim of safe and secure will merely mean from theft, and even that will not be guaranteed. I'm afraid your lumbered with this one.

    every car park I have come accross states they are not liable for damage.
    And I think you'll find that is NOT a lawful "get out clause" they most certainly are liable to a certain extent as you are paying them for a service of safe parking, but I don't know how far it goes to be certain.
