    Default jster v woolwich

    hello everyone

firstly i have to say GREAT SITE

on friday i phoned my bank to ask for statements dating back 6 yearsicon. today i received letter saying "thank you for taking the time and trouble to tell us about your dissatifaction with our service" then a lot of babble about how they work hard to deliver first class service!!! now they have taken responsibility for fully investigating the issues i have raised and they aim to resolve the matter by 2 feb 2007.

i only asked for my statements so i'm now going to send DPA request letter. I've got to hand write it as my printer has broke!

i will keep you posted on my progess.

    Re: jster v woolwich

    please help.

received my list of charges today. total = 2165!!!!! when i send prelim letter it says "i calculate that you have taken £XXXX plus £XXX which you have charged me in overdrafticon interest." does this mean in the first instance i put the total of my charges ie RC, UC, MC, DC, QC, and then add on my OD (unauthorised Daily overdraft fee) for the second sum.

omg i thought i had read enough to understand this early stage. i just don't want to mess anything up.

There are 2 instances of interest you can claim:

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

However, if part of your overdrafticon is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

Vampiress has a spreadsheet, (the advanced one), in the bank templates libraryicon, which attempts to calculate this

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

This is the interest referred to in the preliminary and lbaicon letters.

    2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim

    thanks Michael.

i thought it may had referred to the daily rate of £3 per day for going over my overdrafticon. some of them amount to £78 in one hit!!!! will just add it all together.

    thanks again

    Hi All

Quick update, I have my lbaicon ready to post tomorrow. I have a couple of charges which are due within the next couple of weeks. I haven't added them to my schedule yet as they haven't been applied to my account. I will add them as soon as they hit my account. I cant see them settling before mcol so will add them then!

    Will this be ok?

    update

since starting my claim regarding my open plan current account i stared to claim for my standard current account. (for some reason i didn't think to do them together!!!) anyway my first claim is going on slowly i am due to file mcol late next week. however my standard current account has come to a head now. i sent dpa late january i received cheque back a week or so later and today i received list of charges and letter saying they would credit my account with the full amount. Yipee. but now i have concerns as the customer reference number is the same as my open plan reference number but i am using two different account numbers. will the settlement affect my first claim? am i being paranoid? my standard current account was only for a small amount. i hope this is too confussing.

    Hi Jester
I think the only thing you can do is to contact them and clarify the matter.
The woolwich/Barclaysicon settled my personal account claim at the begining of Jan but i have another claim going through re a c/c when i phoned them yesterday (friday) they thought it was settled (all there paperwork is mixed up) and as i have a hearing on the 22 Feb the guy was over the moon that i contacted them, as they are being served so many defaults from the courts, and is prepared to fax a settlement to me on monday.
    So ring them.
