Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
on friday i phoned my bank to ask for statements dating back 6 years. today i received letter saying "thank you for taking the time and trouble to tell us about your dissatifaction with our service" then a lot of babble about how they work hard to deliver first class service!!! now they have taken responsibility for fully investigating the issues i have raised and they aim to resolve the matter by 2 feb 2007.
i only asked for my statements so i'm now going to send DPA request letter. I've got to hand write it as my printer has broke!

Thanks for reply. i sent DPA request recorded delivery yesterday. I'm trying to prepare myself for the next stage. i have look at vampires spreadsheets but cannot enter data (I did register myself)! i found one on martin lewis website will this be ok to use?
i receive standard letter from the woolwich today saying they aim to provide an answer by 13th feb!!! also received letter from Barclays saying a schedule of charges in course of preperation. (along with my 10 pound cheque)
received my list of charges today. total = 2165!!!!! when i send prelim letter it says "i calculate that you have taken £XXXX plus £XXX which you have charged me in overdraft interest." does this mean in the first instance i put the total of my charges ie RC, UC, MC, DC, QC, and then add on my OD (unauthorised Daily overdraft fee) for the second sum.
omg i thought i had read enough to understand this early stage. i just don't want to mess anything up.
1.When you go overdrawn the bank will charge you interest, perfectly lawfully.
However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.
Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this
It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother
This is the interest referred to in the preliminary and lba letters.
2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim
i thought it may had referred to the daily rate of £3 per day for going over my overdraft. some of them amount to £78 in one hit!!!! will just add it all together.
Hi Jster
Just wanted to say good luck, it might seem like a long road ahead but it'll be worth it when you get your charges back, & everyone on the site is friendly & helpful I know we couldn't have got as far as we have without everyones help we're just waiting for a decision to be made hopefully this week & we started back in October, but like I said its well worth the waitl. Go get em!!
i cant find the answer to my question. i send prelim letter last week however since then i have sent off dpa for a second account i have with the woolwich. (didn't think to do them together) will i be able to add them together or should i do two seperate claims?
Quick update, I have my lba ready to post tomorrow. I have a couple of charges which are due within the next couple of weeks. I haven't added them to my schedule yet as they haven't been applied to my account. I will add them as soon as they hit my account. I cant see them settling before mcol so will add them then!
yes you can add on charges right up until you issue court proceeding once you have issued court proceedings if you get anymore charges you will have to start another claim !
if my advice has been of any help to you then please click the scales ! Thank you
since starting my claim regarding my open plan current account i stared to claim for my standard current account. (for some reason i didn't think to do them together!!!) anyway my first claim is going on slowly i am due to file mcol late next week. however my standard current account has come to a head now. i sent dpa late january i received cheque back a week or so later and today i received list of charges and letter saying they would credit my account with the full amount. Yipee. but now i have concerns as the customer reference number is the same as my open plan reference number but i am using two different account numbers. will the settlement affect my first claim? am i being paranoid? my standard current account was only for a small amount. i hope this is too confussing.
Hi Jester
I think the only thing you can do is to contact them and clarify the matter.
The woolwich/Barclays settled my personal account claim at the begining of Jan but i have another claim going through re a c/c when i phoned them yesterday (friday) they thought it was settled (all there paperwork is mixed up) and as i have a hearing on the 22 Feb the guy was over the moon that i contacted them, as they are being served so many defaults from the courts, and is prepared to fax a settlement to me on monday.
So ring them.
