    Question Crshrimpt vs Barclays (Help Please)**WON**

    Crshrimpt vs Barclaysicon - Claim Amount £1905.00 plus £220.00 court fees

    Current Stage im at: Handed in allocation form with additional £100.00 court fee

    Ok i have just handed in my Allocation form with the additional info section filled out using the information provided by this site. (Thanks for that people).

    I handed it in directly to Dartford county courticon on the deadline date.
    I ask whether Barclays had submitted their Allocation form also, and the response i got was "No". They did mention that barclays could still ask for an exstansion of time. (Judgement to be set aside over a certain period).

    Obviously i now await the courts decision of what proceedure to be taken.

    Is there anything else that i can be doing in the meantime?

    Crshrimpt I'd give Barclaysicon Legal team a call and ask them if/when they've submitted an AQ in because chances are that they have at the last minute, but that it just hasn't hit the court desk yet (they did that with mine). In which case you'll just have to wait for the wheels to turn and eventually for a court date to be issued. If, in the unlikely (but possible due to short-staffing) event that they haven't, just politely remind them to do so. You definitely don't want your case to be set asideicon or delayed further...it'll just mean more unnecessary waiting. You can then inform the courts that you've had a chat with Barclays and that their AQ is on its way.

    Mr Crashbandicoot,

    Have just called Barclaysicon legal team. I mentioned that the deadline for the Allocation had passed and asked whether they had submitted theirs.

    The nice young lady said (in a unsure sounding voice) that they most probably had or will be doing so.

    I did also ask who was dealing with my claim. After a few minutes she returned to phone saying it was 'Charlie Sparling'.

    Im honestly not sure if anyone has heard of him and knows whether this is good news or not.

    She took my contact details and said somebody would be contacting myself soon once they know what the judge's intentions are.

    Is this good????

    That's fine, just sit tight and let things take their course. They won't do anything more until a hearing date is issued, and once you have a date, you'll be in a better position to try and negotiate a full settlement out of them before the date draws closer. Contact names are always good for information purposes, next time you call, ask for Charlie.

    It's just a case of waiting I'm afraid. Wouldn't hurt to call the courts in about a week to see if there's been any further developments.

    Mrs Crash,

    Ok i have finally received a letter from the courts stating that the judge requires a preliminary hearing on the 19th April 2007. He has decided that the claims should be made under the'small claims track' but wants a preliminary hearing.

    Do i have to turn up to this hearing and do i need to submit my court bundle at this hearing....????
