Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I held a finance agreement with Online which defaulted in May 05 as I could not make the payments. I had the car 17 month before it was reposessed and after that I didn't have a lot of contact with them until now. I rang them and found out that the car was sold at auction for £2925 which seemed quite low to me as the car was £6000. Anyway after they sold the car it left my debt balance at £4545 but they added charges for letters and collection fees to a total of £574. Can I reclaim these fees or not ? and can I reclaim fees they might have added for late payments whilst I had the car ?
sorry gavin but not good news. they are entitled to recover their costs in respect of repo the car. Also u paid 6k retail I take it and it was sold at auction for trade value. I would however ask for copy of bill of sale from them to prove it only reached 2925 bud.
Hi, well I am trying to get them to write off the debt as I dont see my circumstances changing much with my financial problems. I will ring and ask for copy to prove the amount
Yes Dee, I can confirm that General Motors Acceptance Corporation purchased On:line Finance in 2005. If you need contact details and addresses for a refund claim please see my thread. I successfully obtained over £1000 back in charges.
