I have been completing the Moneyclaim online for my sister as she was owed £1,000.49 from Nationwide. The sent her a letter last Wednesday (3rd Jan) stating they would pay back the claim, interest and the £120 court fee. However, the claim section of the payment was nearly £200 short so I posted a letter to them on Saturday staing that we accept the offer as a partial settlement, but will be claiming the rest via court if necessary. Today they have submitted a defence.
Has anyone experienced, or heard of such a thing happening?

Same thing has happened to us today. We were claiming £2400 via money online, heard nothing then got a letter dated 5th Jan outlining refunded monies that had been paid into our a/c. usual no offer, acknowledment of court action etc.etc.
Within the figure they included approx £130 that they had deducted in further charges then put back in a day later! We wrote back on the 8th Jan saying we would exclude the latter figure as it wasn't included in the original claim but they were still £951 short and would therefore continue our action unless we received a full payment we also reiterated our continued disgust at their treatment of long standing customers. We've heard nothing from them (not unusual) until logging on to Moneyclaim today to see they actually issued a defence to our claim on the 29th December despite not sending us the 'returned' money letter until the 5th January? nor sending us any acknowledgement of our action or indeed their action.
Does anyone know if this is standard practice and why they would issue a defence but then credit our account without any mention of it being an offer of settlement, without prejudice etc. Surely they would find it hard to submit a defence having paid a lump of money back but not the other part when all the charges are for the same things? They would have to explain then why they considered part of it unjustified but the rest not!

They have NOT paid your Claim in FULL...simple as!!!
Why are U even bothering to remind them of this and engaging yourselves in an war of words that will end up with U getting all upset.
Just carry on proccessing your Claim according to the Court's proceedures.
Nationwide know this full well and that they are just trying to confuse U.
They WILL pay in the end!

Thanks for that MTM, it was as much a question as why they are bothering, by already paying out in part it just seemed that they had already weakened a very weak position. Plus we were wondering if they would go to Court as it would actually be quite a laugh to show the Court the responses they send out to correspondence which are always the same letter! We now refer to them as their 'computer says no' letters including when making reference of them to Nationwide.

Nationwide are no different to the other financial institutions that people are Claiming back their unlawful charges from.
At ALL stages they attempt to deliberately confuse and mis-inform cos they know that statistically speaking, some Claimants will get exasperated and NOT Claim everything that the Banks have unlawfully took in the 1st place, thus leaving the Banks still in profit despite paying out in FULL the odd Claim here or there!
Strangely enough, there are Claimants out there that baulk at the final hurdle and let Nationwide keep the odd hundred quid that they have paid short cos they are fearful of having to go to Court.
Why this should be, is beyond me personally.
Claimants are not up before the Beak for Murder or any other crime, so why be scared of standing up for their own rights???
It is the Banks themselves that are in the wrong!
...Just remember that!!!

Just by way of an update, haven't heard anything from Nationwide until today when we received the 'closing account' letter giving us 32 days notice! Still no response to the letters actually sent to them though nor further comment on the outstanding claim. We're just annoyed now that we didn't get to close it first.

Letter received today saying, following your letter to Charles Bacon, never ever written to him! this is to inform you we are refunding the £915 requested.So again no reference to the Court action or the fact they've entered a defence against our claim but a total refund of every penny.
One point worth noting is that not one piece of correspondence from them has been personal or relevent to the case. Every letter is a computerised print out with one paragraph adjusted to specific figures so if you do get the initial refusal letters, followed by the partial pay out stating your figures are wrong etc. they are all standard. So like MTM says just ignore them and proceed with your claim they're just trying to scare you off and waste your time.

hi.got the same letter today from Nationwide partial payment £761.21+14.42interest+£12 0mcol.The claim is for £1557+interest phoned Richard Huntley up who sent letter saying l have,nt excepted the offer and its still going to court.His reply send all details of the charges you bet l will.let you know what happens next times running out for nationwide.

Hello All,
Nationwide have done the same to me. I'm claiming back £4600 in charges+interest. They shoved a measly £250 into my account and sent a letter 2 days later stating this. I havent replied, just carried on with my claim.
But here's the best bit. This all started when they took my overdraft away from me, giving me 10 days to pay it back! obviously I couldn't, so things got out of hand and the charges started piling in. Putting me further and further in debt. Since filing my complaint, they have had the cheek to write and inform me they've given me an overdraft!!!!!!!!!!! which is more than my original one....... I laughed.
I havent used this account since filing for charges refund, so the overdraft is to cover THEIR charges that have been left sitting in the account. My claim at the moment only goes up to July 2006, and since then they've put another £1300 in charges on the account... do they really think that now I've got the hang of this claiming back business that i'm not going to claim back from July to date.
Not very bright are they...... but it gave me a giggle

Hya you seem very sure of your position and that makes me a little less scared of my two claims which have been lodged with court. Nationwide have issued me with a intend to defend but im not getting any money back in dribs and drabs in my account and this is unnerving me, do you think they know something that I dont? maybe I made a mistake in my calculations or something and they know it would be chucked out on that basis.... they have taken my overdraft away and want the lot back within a week do you think thats a good sign? Im also concerned that all the successes seem to be in 06 and that things may have moved on from then?
