Tax credits will not provide me with proof, now i cannot claim!
Hi all,
I am trying to put in claims for charges on my credit debts, e.g. catalogue debts.
I had a problem with my tax credits last may and they started paying me manually instead of into the bank they will not send me proof of my benefit so i cannot get the free service provided by my local court, i need proof within the last thirty days.
Anyonee have advice about this, tax credits are useless and dont even know what is wrong with my claim!

Well I used to work at a Tax Enquiy Centre until 8 weeks ago (retirered - heaven!)
Did you just phone hem or have you visited an enquiry centre?
Suggst you try visiting and stay put until something is done for you. They should have acess to the info at the Enquiry Centre- try asking for a letter of confirmation of amounts received.
They have an appointments system .
PS - just remember the people you see did not deal with your tax credit claim and are there to help you

Even if they are paying you manually, they should still send you an award letter stating how much you will receive for the current year and how payment will be made. Then show this to the court.

Are they giving you any reason for refusal?
I would ask for the contact details of their data controller and consider action under the Data Protection Act for failure to disclose information. This might also be a criminal offence if it causes loss to someone (you can't get the free service) under the new Fraud Act (15th January).

It doesn't matter whether you have an award notice or not, the courts won't accept it unless it's less than 30 days old, which is where the problems are arising.

Well under normal circumstances, you would get a provisional award at the beginning of the tax year based on previous figures.
When the renewal forms are received by them, they issue a revised award based on the P60/benefit dets you have declared for the previous year.
They wouldn't issue a revised award unless there is a change of circumstances throughout the year.
So, its quite likely your award would be over 30 days old!!
Seems a silly rule by the courts to me. I know award notices, providing they are for the current year, are accepted by other agencies, such as local councils etc. Can you double check this rule? Its not just one person there that perhaps has it wrong?
Also you could try phoning the TCO again and ask for a Supervisor. If no luck with them, stay on line and ask for the complaints dept and threaten with a letter to your MP.
It really is a quite simple process to isue a duplicate award. The only other thing you could do is ask them to send youa leter onfirmng the amount of award and oayments you are receiving

i didn't know about the '30 days' rule. I have used my award from the beginning of April at court sometimes throughout the year (when the DCA has taken me to court and i need to apply for variation/hearing etc) and they have simply accepted it. No-one said to me it is older than 30 days.
