I have sent two letters requesting a full refund and have recieved two letters back. The second offering 50% refund but the account will be closed on 30th January as they say "I obviuosly cannot adhere to the societys terms and conditions".
I have been considering accepting the 50% as I was a bit weary of the court action business, but thanks to charmikjel and her success I am going to go for every last penny.
The problem I have is that I'm not quiet sure about the details in the lba letter I need to send. The advice in the faq says to accept the 50% in part and then persue the rest via the courts. I would welcome any advice on this, i have already prepared my LBA letter and ive just used the template form the librbary, ive just filled in the dates and amounts etc. It is sitting ready to be posted but I will wait for any advice first. Im dying to send it off!!!

It looks like N&P have closed my account but credited it with funds to clear the outstanding balance without any reference to me!

Recievd reply to lba, they say after checking there records they have found no record of my previous letter (letter before LBA). The points ive raised are recieving attention and the Banking & Investment support manager will respond within ten working days.

I recieved two letters today, the first dated 11 Jan was what looks like a final statment with a credit to my account for the overdue balance. It looks like my account has now been closed but they have credited my account with the overdue balance?? All of this is news to me!
The second letter is below, it is dated 12 Jan. They have the cheek to refer to my husbands letter!! I'm a bloke and not even married!!! Just checked and there is no typo on the letters ive sent. I recieevd a very similair letter to this back on the 5th Dec.
Anyway, it looks like I have no option now but to start action as threatend in my LBA.
I am thinking about calling them tomorow to see whats going on but I dont like the phone as I prefer to have somthing in writing and have a really bad memory!

With reference to your husbands letter dated 4h January regarding charges on the above numbered account. This has been passed to me for reply in my capacity of Banking & Investment Support Manager.
As stated in the terms and conditions of the Gold Current Account, you are required to have sufficient cleared funds in your account the day prior to an item being presented. Should you fail to do this then the item will be returned unpaid and a charge of £29.50 levied.
The Society believes it has acted lawfully at all times when operating your account and we have simply enforced the advertised charge structure, to which you'agreed when entering into the contract with Norwich and Peterborough Building Society (the application form you signed on opening your account included a declaration and agreement which stated that you had read and agreed to be bound by the conditions of the account).
The Society is owned by, and listens to, its members and we recognise that mistakes can happen so, if a customer makes a mistake and they incur a fee we will refund the first one on application. Thereafter, to be fair and consistent to all our customers, all future fees and charges will not normally be refunded unless there were exceptional circumstances that we feel should be taken into consideration. In your case, I can see that we followed !hisj)glicy when in May 2006 We refunded a fee that had been correctly applied to your account. At that time, you were reminded of the terms "and conditions for operating the Gold Current Account and advised that all remaining and future charges would stand. By continued use of the account, you have indicated your acceptance to all terms and conditions of the account
