My question there is really what might constitute proof? Since you say the issue of delivery is a common one I suppose that no satisfactory answer has been established or you would probably have told me.
    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

here i go again already claiming charges from the halifax and barclays for a lot more, but while claiming from barclays via money claim rbs decided to take a charge from my account. my fella rang and asked for it to be refunded andthey refused, they then decided to add a few more charges over the xmas period (the fools, you think they would learn). i phoned the other day and asked them to refund the charges and again they refused until i stated that what they were doing is wrong and the only reason i was in over my overdraft was that they have taken charges out. they refunded £38 into my account still leaving me over, with a £28 charge looming if i don't sort out my account.

so, i am writing to their h/o with a letter giving them 14 days to refund all charges (its only £106 so i'm hoping they will reconcider) or my first letter goes out to them.

is this ok or should i leave out my letter and start the process now?

It's worth giving it a try as it's only a small amount.

 

If that doesn't work then wade straight in with the preliminary request letter from the templates library.

Stick to your timetable, not theirs.

i won ha ha ha

just an update i sent rbs a letter on the 8th of jan basically asking for them to return my £108 in bank charges to me or to face further action. on the 22nd of jan the sent a letter saying " i'm sorry you have concerns blah blah blah ........... we believe that these charges are fair, reasonable and transparent.(whatever) blah blah blah ...................... however we have reviewed your case and as a gesture of good will and without admission of liability or error in this instance we are prepared to offer the amount of £108 blah blah blah......................

i'm quite suprised really as i didn't use the standard prelim letter not got my money yet though so i'll keep you posted

they threatened to close or downgrade my account if i went for they charges again has this happened to anyone or is it just a threat?

can anyone help with the previous post as the rbs has taken over £300 in charges off me in the last 3 months wondering whether to open a new account now or start with me prelim as i have all of my statements

Well as no one gave me any advise i deceided to open another account anyway just incase.

On thursday when the post came with a standard letter from the RBS saying they will get back to me in the next 6-8 weeks. They have till next monday to get back to me otherwise they will receive my LBA.

Just finishing off my case against barclays so have the funds to go to court nevermind i suppose its more money in my pocket. :D

Well i didn't get anywhere with the above claim and after receiving the standard letter after the high court hearing i gave up my quest of reclaiming my charges.

 

After moving house and opening a new bank account i realised the cheeky rbs had continued to take charges out of my account taking the total to £708.

 

So i've sent a new prelim stating amount taken before and after the hearing, lets see how i get on this time !

You poor thing:cry: After reading your thread, nobody responded to your posts:???:.

 

Yes you are right to restart your claim and it was advisable to open up a new account, as they can get a bit retalitory:mad:

 

Start by sending of your prelimary letter asking for them to refund the money they have taken. They will respond with the "Thank your for your letter, thankfully we can still take these charges, but do not have to investigate your complaint, but will add it to our mountain's of other claims till the outcome of the test case.

 

Then send your LBA and if no response of the same. Issue at court:-D

Recieved a letter from the lovely RBS today (pretty quick for them)

 

Thank you for your letter regarding your claim for charges.

As outlined in our previous letter to you, will will resolve your complaint once legal proceedings between the oft and the banks are determined

We have registered and stored your complaint.

 

If you would like and update on the latest postion regarding proceedings

visit our website Overdraft charges update- RBS - The Royal Bank of Scotland

 

Will give them another week as they haven't had 14 working days yet then lba will go off.

well not had the money to go to court just yet.

Received a letter from the lovely rbs saying that i'm nearly £400 overdrawn on my account. My reaction wasn't pretty i think a few f's and jf's were in there.

 

Anyway i replied to their letter telling them that the reason i'm overdrawn on my account is that they have taken penalty charges and interest and shoved there, even though the oft is looking into their charges they still think its fair to slap them on peoples accounts, asked them to remburse me

 

My lovely mother has loaned me the money to pay it off (hopefully without interest and PPI) so i don't get any more charges on there.

 

Just had a win on a PPI claim as soon as i get my money on them i'll issue a court claim.

Yes it is truely disgusted regarding this one sided waiver granted by the FSA:evil: Basically telling customers to shut up and the banks business as usual:rolleyes:

 

Possibly a mass complaint to the FSA is needed regarding the unfairness of this waiver.

 

The FSA is always spouting their principle of treating customers fairly, yeh right.

 

Glad to hear that you have been successful on a claim for ppi, who was that with????????

 

As soon as you get the money, get a N1 issued against the RBS:D

Received my statement today !!!!!!!!:mad:

seems the new word for their charges is MAINTENANCE, I DIDN'T ASK FOR ANY MAINTENANCE.:mad:

 

WHATS ALL THAT ABOUT ????????????

 

OH HOW I HATE THE RBS.

 

Any way received my cheques from my ppi win against alliance and leicester today so hi ho hi ho its of to court i go (just as soon as they have cleared).

I received the email off money saving expert about hardship claims.

 

As i'm currently on statutory maternity pay, i would see myself in that position.

 

Letter goes off tomorrow, we'll see how it goes? They'll probably say no but you never know;)

Hello Ronvin,

 

Disgusting state of affairs, you go and get them.

 

They are sitting pretty at the moment with the waiver in force, and meanwhile normal people are struggling. A computor unfortunately does not know that you are on maternity leave so tell them that you are experiencing at present.

 

Lets see what they come back with and if not to your satisfaction, report them to the FSA.

Recieved a letter from rbs today, sorry but were not giving any money back blah blah blah, but if you fill in this form about your finances we'll take a look and probably offer you some more credit and still not give you back your charges !!!!!

 

We'll see how it goes anyway, you never know

all filled out and sent back to RBS with a statement about whats happened to my circumstances to make me suffer financial hardship, (oh could it possibly be the £800 taken in bank charges) ;)
