    Default bigmama v Woolwich

    I went into the branch to see if they could print off last 6 yearsicon of charges as it's quicker but they couldn't and the woman said it would cost £5 per statement if I wanted them. I will be sending a SARicon with my £10 on Monday then we'll see what happens

    Of course your aware bigmama that the woolwich have 40 days to comply with you S.A.R - (Subject access requesticon) and will usually be in no hurry to dispatch your data to you but it will be within the 40 day limit in the meantime as BIGAL has advised you take the opportunity to read as many threads as possible so that you know how this process proceeds and if you need any advice or help just post it here someone will be along to answer your call good lick and happy reading !

    Have you added interesticon (try compounded contractual) that will bump it up loads. You would add this from the word go.
    If you use the other Stautory 8% you only add this when you file a claim at the court.

    Ok this is a loooooooooong thread btu well worth the investment of your time it will increase your claim (if your charges go back a long way) by a huge amount (if the charges are recent then it may be easier to calim Statutory interesticon).
    There's plenty of help on the thread Mindazi and a mad but nice Gorilla!!!

    With CCI you are only reciprocating exactly what they have done to you.
    ie. you have insufficient funds for a DD, they charge you £35 and interest on that £35 at their unauthorized overdrafticon rate (say 23.9%)(remember they are doing this because you have no money in your account and they are lending you the money for the penalty charge).
    So as their charges are unlawful because under your contract with the bank they can only charge you what it actually cost them (pennies) as such the rest of their charge is undue enrichmenticon.
    All you are doing with CCI is applying the same % charge as they would, but of course if your happy with 2K less thats fine you must be sure in your own mind what you want to do.
    I would personally read a few more threads on CCI and decide for yourself once you have submitted your claim to court you cannot change your mind .
    Your woolwich claim will probably not get dealt with for perhaps 4/5 months mine took 6. If i had known about CCI back then i would have spent another 2 weeks or so looking at CCI in a bit more depth.
    But i have received my statements from Marbles CC and i will defiantly be using CCI against them.
    Hope this makes sense.

    I've just realised that was the authorised overdrafticon rate, with the unauthorised rate it goes up to £12329.36 Can that be right??? How would that affect it when it goes to court? It would cost me more and it wouldn't be in the small claims court anymore so what court would I have to go to?

    HI Mama
    Well i believe there are several people on here that say it is the amount of the penalties alone and not the interesticon added that the court looks at, someone on one of the CCI threads was tring to get it verified through the court. I have just done £640 of penalties and i ended up with £1200+interest to go on top.
    It does mount up rapidly a £20 charge in June 2003 rings up £27.74 interest then you have to add the interest they have charged you on that too and the rate im using is only (ha only) 23.9%.
    Im sure if you uncertain by posting your above question on one of the CCI threads someone will anwser you, or PM Bill-K the friendly Gorilla he's brill and explains things so it easy to understand.
