Thread: Jimbo vs Egg

Just got my reply from the lba which seems pretty bog standard 'charges are fair blah blah', they have said they will credit me with £4 for each default charge (£96 in total) which i'm obviously not going to accept, should I advise them of this though or just proceed straight to filing with MCOL on the date I originally advised them?

On my original letters I was solely asking for the charges back, thought about this now and on the MCOL, could I now change this to charges + contractual interest? Would more than double the claim and obviously want to take them for as much as possible!

Let this go off the boil (pardon the pun) so have just called Egg to use a tactic I saw elsewhere, telling them I am on the steps of the court with my claim form and would they like to settle right now to prevent any further costs to themselves.
The person I spoke to said they would but I would need to put this in writing (smell a rat here!), anyway, thought I would humor them and give them one last chance so have put this together, by no means a legal expert so anyones thoughts would be appreciated?

Further to my telephone conversation with you on 25th January 2007, during which I asked if you would be prepared to settle my claim in full to bring this matter to a conclusion and to avoid your organisation having to include my court fee’s and statutory 8% interest in my claim, to which you replied, and I quote, “If you get that request to me in writing, we will be able to do that” , I am writing for the final time before commencing legal proceedings to ask you to refund to me the charges which you have levied from my account over the last 4 years, totalling £460.

I included a schedule of charges within my previous correspondence so trust this will not be needed again.

For maximum credibility with the Egg's layer upon layer of bureaucrats, suggest you mention the name of the employee who gave this undertaking, and if name not known, then at least the time of the phone call.

And that if they choose to dinhonour their verbal undertaking you will broadcast their breach of faith far and wide.
