I heard about this website on LBC. I spent most of yesterday browsing the the site. I sent my first letter to Abbey today. A few years ago they canceled my overdraft with only a weeks notice. They then put some kind of freeze on my account. They took my cheque book and my debit card. When I needed money I had to go into the branch who would then make a phone call to see how much money I was allowed to have. Over this period I paid thousands in charges. I was ashamed and so accepted it. I did two jobs and eventually paid it all off. I have been charge free for about 2 years until last month. I went overdrawn by £70 for 1 day and they charged me £110. I am know b****y angry and will be claiming back every penny they have taken from me.

But all we are doing is explaining existing legal principles to you.
You will have to be satisfied that the charges are diproportionate penalties - and of course you will have to be able to prove it to a court as well if you end up going to court.

I have just recieved my statements today. Problem is they only sent me one years worth. The one year when there were very few charges.Not sure what to do next. Any advice.

Yes I did use the DPA template. I recieved 13 seperate statements this morning. Is it just coincidence that they sent me last years where they made very little money out of me?
I am assuming that you also sent the £10 fee - this is critical.
The statements that you have received will be the information that they claim is held on their current computer system. The remainder is stored on microfiche and should be sent seperately.
However, they seem to be in a mess and working through a big backlog, and it is likely that you won't receive anything until very close to the 40-day deadline. Indeed, the Information Commissioner is already starting to get a trickle of complaints from people who have waited beyond the forty days.
I expect that trickle to turn into a deluge over the next couple of weeks.

I did not send the £10 because I sent mine 8th March 06 and it was suggested that they may ask for the £10. They never did. The Data protection Template did not mention the £10, but I have noticed it does know. Should I send another letter including the £10?
Since they sent the statements to you under your DPA request, then they are acting upon it - best not give them any excuse to delay. It is likely that they only started to use the £10 fee as a delaying tactic after you had sent your request.
It may be worth writing to them to acknowledge receipt of the statements you have - and also reminding them how many days they have to comply.
