    Default Private Parking Fine

    Hi All,

    I would appreciate any advice anyone can give me(and my neighbour) regarding dealing with the above!
    I have seen similar posts to mine, but am unsure about the likelyhood of successful appeal.
    My circumstance is that I received a £200 (£100 in 14 days) charge last night(neighbour the night before) whilst parked on private property belonging to my own landlord (it is for the shop below us but I parked there at 8.40pm knowing I wouldn't be in his way).
    There are two separate parking companies noted on the walls of the "yard" with one posted just to the right of where my car was parked, it looks new and I have been parking there occasionaly for the last 12 months without a ticket.
    I noted on the fine that the reg and colour are correct but the car is described as a Fiat Brava, my car is a Fiat Bravo.
    Can anyone see grounds for me to genuinely dispute the fine (without ending up paying £200+

    If you mean can you dispute it because of a one letter typographical error, then I would say probably not.

    Is there some other reason why you feel it could/should be disputed?

    Thank you for your reply.

    I have stupidly left the notice at work, however it is hand written so the letter is supposed to be an A rather than an O - The Bravo and Brava are slightly different cars one being a 3 door and the other a 5 door.

    My additional issues are:

    1. the fine mentions 'trespass notice', I believe, yet I am parked to the rear of my property which I pay rent to live and council tax for plus the space/land is owned by my landlord (the freeholder).
    2. the sign is to the right of where I parked and so it is unclear which bays are/are not subject to clamps/fines and which aren't, there are no bays, just a yard that fits about 6 cars, which is in need of relaying.

    really appreciate any help given

    The issue of private parking fines is discussed at length on threads in this forum and on Pepipoo forum which is similar to this but more about cars than bank charges.

    In summary

    A private parking fineicon is little more than a contract between the person who parked it their and the enforcement company.

    They will claim by parking their the driver has agreed to pay the £100

    The only route open to them to enforce the fine is thru the civil courts against the driver not the registered owner.

    This would only realistically be succesful if they could prove who the driver was and that the driver accepted the contract.

    I am know expert on this but there appears to be a universal reluctance for any of these companies to take this route as I imagine they think they would loose.

    This of course does not stop them threatening all sorts but from the posts on this and other sites it appears to be empty threats.

    this begs the question. If you own a parking space ie. in front of your shop how do you ensure that no one parks on it ? Im not sure about that.
