Had this letter from Mint (RBS) today after communications regarding my debts the last couple of months where i have explained i have no job, offered £5 a month, asked them to freezer interest/charges and given income/outgoing statements but i am a little unsure of how to respond to this now. Any suggestions appreciated!
Dear Mr x
A default notice has recently been served on you. As the amount requested in the Default Notice has not been received, your account has been terminated.
Full payment of your outstanding debt is now required within 14 days. However, I note that you have made a request to repay the debt with low monthly payments. As the suggested amount is less than the required 2.25% payment, after 14 days your account will be transfered to our debt recovery office. You will then be contacted regarding the outstanding balance, in particular your request to make payments below the required 2.25% of the balance each month...
..Interest will continue to accrue at the contract rate...
Your account will be reported to the credit reference agencies as a default if repayment proposals acceptable to the bank have not been made within 28 days of the date of this letter. If this becomes necessary, your name will remain registered for 6 years.

Are you claiming back unlawful charges from them? If so then they can't default your account as it is in dispute ... if not then they can't get you to pay money you don't have ... basically they will prob pass your debt to a debt collector & possibly take you to court which will result in a CCJ & the judge will order you to make payments. This isn't totally bad news as they will consider your disposable income & you will be able to pay an affordable amount ... also if it goes this route it's apparantly more likely that the interest will get frozen.
There is nothing you can do about the bad credit record/default if this happens as basically if you can't afford to pay then it is justified to go on your record.
I've just started a dmp with the CCCS & they give lots of advice about this sort of thing ... here is a link to their website if you think it may help you. CCCS -
At least you've been trying to speak to your creditors & keep them advised of your situation rather than just ignoring them .... this is the best policy ...
Thanks for that Chezt. Actually a letter from mint this morning says they are freezing interest and charges and letting pay £1 for 6 months so i've got some breathing space now at least. Thanks for the CCCS link too!

just be careful hey still dont enter the default against you.
i had an arrangement to pay with them, they agreed the amounts, froze interest, accepted the payments, but still entered defult on my credit file.
i am fightingthem now to get this removed, as i feel its not an acurate reflection of the account, but not having much luck as yet!
As I pointed out in my first post - unless the account is in dispute (ie you are claiming back charges) then unfortunately there will be nothing he can do about the default as he has defaulted ... I'm not sure if this is the case or not
