Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am a newbie to these forums, so please be gentle with me!! LOL
I have just filled in my Data Protection Act letter and wasn't sure who to address it to? There seems to be quite a few contact names on the site. Please let me know what you think?
Thanks Guys
Jodie

Data Protection Act disclosure request
Dear Sir/Madam
ACCOUNT NUMBER:
Please supply me with a complete list of transactions and charges relating to my bank account since 05th December, 2005. Alternatively a complete set of bank statements for that period will be acceptable.
Additionally where there has been any event in our account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you.
If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.
We enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if we discover that you have levied disproportionate penalties against us then we shall be reclaiming them and also reclaiming the enclosed £10 DPA disclosure fee.
Fingers crossed - although you forgot to add what you wrote...

Below your account number, you may want to put your date of birth, branch location, anyting you can think of. This will stop cut down the chance of them writing back asking you to prove yourself, etc. Just ssomething I do..

can i just clear up.. i am just starting a claim today too and i have 2 accounts with HSBC so should i be sending two separate DPA letters with 2 cheques for £10 for each of the account, i can just put it all in one with £10?! And best to hand deliver to branch manager?!
I was advised to do one letter and put both account numbers on that letter. Also just put 1 cheque in which they will probably send back to you. Hopefully!!
I am sending out my letter tomorrow, recorded delivery to my branch manager.
Let me know how you get on sounds like we are claiming around the same time, be funny to see what bresponses we both get.
You can claim for everything on your statements that is not a justifiable service fee:
Claim:
Penalty Charges applied to your account. This is for exceeding overdrafts, referral/representation of DD’s and SO’s, cancellation of DD’s and SO’s, card misuse charges…the list is long!
Interest charged to your account for any of the above
When the interest is applied to the penalty charges, then this interest should be included
If your transaction history identifies what interest is applied for what reason, then be honest about the amount you request
If the interest is not itemised, then claim for ‘Interest Charges,’ and the onus will be on the bank to demonstrate the proportion they are entitled to
Don't Claim:
Agreed fees, such as £5 monthly overdraft arrangement fee
Any concept of costs or time at this time
Interest other than that which appears on your statements
Interest at 8% APR (that comes when you raise your claim at court)

I made a little boo boo!! I sent my 1st letter recorded delivery to my Branch Manager on the 20th (Yesterday) and the Branch Manager rang me today, everso polite (would she be anything else!) and said I can either print my statements off of the Internet Banking as I have only had the account opened since December 05 otherwise she will send them to me free of charge and shred my cheque!
Silly me though when I checked I have all my statements from them anyway with the charges on. The charges amount to 300 quid roughly still need to work it out tonight but should I now send my 2nd letter?? and who should I send it to? The same person or not??

If you have interent banking set up with HSBC you can indeed get them all on-line for the past 6 years. Doesn't go back any further than that, but that is enough. Once you get to where you see the current transactions for an account on the left hand side you should see a "My Statements" link. Click on that to show them. You need to select the one you want to look at, then click on continue to display it. You can print it or save it to your hard drive for later viewing. You won't see any menu to choose from, but to save it try "Ctrl + S". Works in Firefox and should work in IE as well.
Hi All. Been in town today and walked into HSBC branch to ask for all my statements dating back 4 yrs. Got the "what do you need them for?". After being told it's gonna cost me £10.00 from my account which is already over the limit, I accepted and was told to come back in 1/2 hr. Great, picked up the thickish envelope and now I am ready for the battle. Will keep you all informed so please wish me good luck. I so want to get this right!! Am shopping for a parachute as well just in case lol.
PLS START YOUR OWN THREAD, YOU'RE HIJACKING SOMEONE ELSE'S.
Although HSBC internet banking does allow you to print off the last 6 years of statements and is very useful these statements do not include notes about manual intervention which is what the DPA letter and £10 fee covers.
