Unheaded letter also dated 16/11/20 from NewDay saying they assigned “all of the respective rights etc,”  to Lowell on 23/10/20 I make this 9 relevant pages from what I can see   ( all other pages are statements/default notes and lots of FCA info sheets) just needing your confirmation in advance as I don’t want to send over pages that are not required thank you  UCM      
    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been following this site for a while considering my options. I have most of my statements from BOS for my joint account stored online on their online banking website. So today I printed all the statements I had and totalled up charges of £682 in about 11 months.

 

I've written a preliminary letter to my branch asking for these charges to be refunded and sent it recorded delivery today.

 

I also have my own personal account, for which i plan to request statements for the last 5 years as i am certain this will be a four figure sum. However I thought it would be a wise move to open another account with a different bank first before I further any action on this account.

 

I'm probably just like everyone else here and have become frustrated at my bank's aggresive charging policy and have just had enough. Since the merger with Halifax I have found BOS very unreasonable and impossible to deal with.

 

So here goes nothing....

Hear hear! Bring back old Bank of Scotland, I too do not like the change of attitude and policy.

Bank of Scotland round 1: £740 + costs settled, still sore over the 8% grrr

Bank of Scotland round 2: £629 +101.15 interest +£39 costs settled.

I have received a reply from BOS. This claim was for my joint account and I also sent a DPA request letter in relation to my personal account (clocks v BOS#2).

 

I received a reply 20/5/06 from BOS. They have combined my two request (LBA and DPA requests) and replied on behalf of both of them it seems.

 

They batter on about extra costs incurred blah blah blah. Then "Ultimately it is your responsibility to manage your account. However, as a gesture of goodwill I am prepared to refund £700 of charges in full and final settlemwnt of your complaint. I must stress that future valid charges will stand and we reserve the right to close your account if you do not manage it correctly....."

 

They have also provided me with statements for my personal account as requested until May 2004 but have given me a list of charges since then. I've totalled them up and my claim is for £2086. If you add my claim for my joint account £818 then my total is £2904. That works out at 24% they are offering.

 

However, if the £700 offered is solely for my joint account (LBA issued asking for £800 approx) then I would be willing to accept it but I doubt it. I will phone them on Monday to find out.

 

I have gained some confidence now - I don't think they would have offered me £700 if they thought they were in the right?

Phoned bank today (Monday). I told them I would not be accepting their offer of £700. It was then upped to £1400. I have not accepted or refused this yet as it is a lot of money to me. Basically its approximately 50% of what I have been charged for both my accounts since 2002.

 

I'm edging towards the opinion of refusing and continuing my claim - especially after re-reading Candice's posts. I am prepared to go to court but it will take 2 small claims to only match the £1400 already offered.

 

I'm really in 2 minds here, so any advice or support would be appreciated.

You know its up to you, but I woudln't take it personally, £3000 is alot of dosh...however you are inscotland so you will be a bit longer in claiming

I received my updated offer of 1400 squid yesterday. After much thought decided that it wasn't enough.

 

I phoned BOS today and said in view of the total amount of charges (£3K) that I didn't feel the offer was enough and that I wanted the figure to be in my favour - that i wouldn't settle for less than £2K. That's about 2/3 of what i was owed.

 

I was quite surprised when the guy at BOS said ok.

 

So I will be accepting £2k out of a possible £3k claim. I do admire you guys who can go all the way in Scotland through the small claims court at £750 a time but I feel that I have to accept this offer. After all, £2k is 3 and a bit small claims. Plus I'm pratted and I need a fighting fund to go after my credit card companies now.

 

So thanks to all you guys here for the motivation and encouragement and I will be donating when they cough up the cash.

Wow. That's a new development for sure. They tend to stick to their 12.7$ + 25$ formula (i.e. offer low, then more). Mind, your offers seem different to the pattern seen previously anyway!

Bank of Scotland - £4000+ returned. Scottish resident, scottish accounts, but it's Halifax Bank of Scotland now, so took 'em to court in Halifax. One small claims, one defence filed, one refund of all charges + interest! Done and dusted.

Next - Capital One :D

Since my last post I have not yet received the improved offer yet by post. I phoned yesterday (Tues) and the lady said it would be sent out in a few days.

 

Seems they might be a little busy at the moment methinks!
