    Mazza v Barclays **WON**

    Hi
    I have followed the guidelines on the website to claim £1674 including interesticon from Barclaysicon.

    I have filed a claim online and Barclays are defending it. I am now terrified and not sure what to do next.

    From the court I have received:

    Notice of transfer of proceedings to my local court.

    A letter asking for a further £100 as the claim is over £1500.

    An allocation questionairre - N149 - to be completed and returned by 16th january.

    Barclay's defence and counterclaim which disputes the full amount and gives their defence over 3 pages. This makes horrific reading,

    Please help - I need to know what to do next. Do you think I should continue my claim?

    If I get a date for court - what should I do to prepare? Are barclay's likely to turn up?

    How do i ger a court Buddy and how does this work?

    Help!!

    Default court

    I am in the process of trying to get my charges back from Barclaysicon-allocation questionaire goes in monday-do I need to send list of charges with it. Also I notice from reading everyone elses 'stories' Barclays' offered a settlement sum(though this was always refused) in many cases. I was offered nothing-does this mean they are moer likely to turn up in court -very worried!!!!!

    Yes send the schedule.Dont worry about not getting an offer yet..some get one early others later some not at all its nothing to worry about.Get the aqicon in sit back and wait.
    Chances of you going to court are much more likely than them going ......if you get my drift !!

    i'm at the court stage been giving a date but one of my claims the judge is ordering it 2 b struck out because of limitation acticon 1980
    y do i hear you ask well because in my claim i had august and september 2000 and i started my claim in oct 2006 well my claim is for £3300. and the amount for aug and sept 2000 are a big sum of £20 well it says if i object i need to make application to have it varied set asideicon or stayed with in 7 days HELP i dont no how to do it and our local court shut today cos building work don't think nerves last till monday has anybody any idea what i do where i go

    Default help-court pending

    Took my allocation questionaire to my local court jan 14th. Court date set for 25th May(even though I tolg them on aqicon on hol at this time)
    Sorting out info for court bundle-do I need to highlight all relevant parts -eg in relevant case summaries, supply of goods and services act, unfair contract terms act etc... or can I leave as they are .Reading through other peoples experiences Barclaysicon appear to be takin many people to the edge -very scary-have been tempted to give up but got this far!!!
    should I be ringing barclays to try and settle or just wait ?

    Got my court date 20th July -very nervous-can't get through to anyone at Barclaysicon so no settlement yet! Looks set to go all the way. Do I need to put in all bank statements or just the ones with charges on them. Is Krysta Campbell the person I need to speak to?

    Just the statements with charges on will suffice. After all we can do our bit to save the environment even if Barclaysicon don't by sending out 100's of 1000's of computer automated letters to its customers with unlawful charges on.

    thanks-sent bundle now-statements with charges on only-hope they settle,not looking forward to court battle. No one returning my calls from Barclaysicon. No surprises there!!!!

    no court bundle from barclays

    Hearing on 20th july should have recieved court bundle from Barclaysicon FRIDAY 6th-didnt arrive-had email from Tom Hinkley on 5th who will contact me before end of next week-no offer of settlement.Do I imform court I have not recieved bundle? Any one know if not sending bundle has any implications for Barclays

    A court bundle is not or HAS NOT to date been submitted by B's purely because they know they will not be attending court and therefore do not need to spend the time preparing one.

    Email the team stating you are aware of the missed deadline and are going you apply to get their defence struck out on the grounds of not complying with the courts directions.

    then go on to mention you are wiling to settle out of court.

    I don't think Barclaysicon have ever produced a court bundle as it is never needed. You will get your offer of settlement at the very last minute.

    Emailed Tom Hickey again today explaining applying to court to have B defence struck out for failing to comply with court directionsetc etc and that I was willing to settle out of court he emailed back-letter had gone in post 1st class yest so I should recieve it by tomorrow!!!
    Slill no offer of settlement or any ref to what might be in letter. what do we think folks-settlememt offer or knock back?
