    Default Offer Received - Advise Required

    This morning I recieved a letter from the HSBCicon service team with an offer of £1763.10 but I have already filed my MCOL for £2504.34 + £120 for the court fees and this was acknowledged on the 21/12/06.

    Should I accept this offer?

    I have received the reply from DG advising that they intend to defend but I understand that this is standard for most claims.

    You can either ignore it or send something along these lines:
    Dear [named sender or Sirs]


    Thank you for your letter dated xx/xx/xx. Prior to receipt of your letter I have filed a claim in the county courticon and have therefore incurred further costs.

    I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, interesticon and court fees now totalling £xxxx

    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

    I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim.

    I trust this clarifies my position.

    Only you can know if you want to accept this offer. The truth is, not one bank have managed to even attend court to defend a claim thus far, so if you can wait, you will receive the full amount.

    If it were me, I would accept this offer as a partial payment only and inform the bank that unless they made a full payment then my claim would continue.

    iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.
    Vanquis - Claim issued, no AoS or Defence received

    Can someone just confirm what I need to do now that I have received the Acknowledgement of service from DG? Someone said that I have to send something off in the post to DG and the Court..

    another consideration - this is an offer from the bank, right? if they were so keen to settle - why did it take them this long. it is sorting out the weak from the strong - and to their benefit (like to the tune of about £1000), figuring another couple of weeks to their (dg, not the bank) offer and another couple just to be safe - £1000 for another 3-4 week wait - only you can weigh it up. kind of like deal or no deal without noel!

    if you decide to carry on - have you sent a copy of your Breakdownicon to dg referencing your claim number (that can shave a couple of days off the wait),
    if you've been following other threads - you'll know dg doesn't usually offer until just before or just after the defense is due to be filed (28 days from your date served). dg's address is on pg 2 of your acknowlegment.

    Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

    The Court Manager,
    Money Claim Online
    Northampton county courticon
    21-27 St. Katharine's Street
    Northampton
    NN1 2LH

    Dear Sir/Madam

    (Your Name) –v- (Bank)
    Claim No: ********
    Date Issued: xx/xx/xx

    Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interesticon claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

    I respectfully request that the enclosed schedule should be attached to the particulars of my claim.
    Yours sincerely,

    Wait until you receive the Notice of Acknowledgement from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

    Dear Sir,

    (Your Name) -v- (Bank)
    Claim No: ********
    Date Issued: xx/xx/xx

    Please find enclosed a copy of my schedule of charges relating to the above claim.
