Made a start to recover charges against my husbands credit card from about 4 yrs ago. Not sure how much yet but will probably be alot due to all the phone calls i remember that we received!
We cleared the card when we moved house a few years back and closed the account. We found a reference number for the card and rang them up today!
I have been given an address in chester to send the data protection letter for the bank statements. I have a few questions that i would appreciate being answered....
Firstly, the guy we spoke to on the phone reckoned that they charge £2.50 for every year of statements you claim for. Can they do this.??? I was on the understanding that the max they can charge is £10....whats everyOne elses experience with the charges????
Secondly, the guy also said that they will not send out every single statement for the last 6 years, only those with transactions on......personally i don't feel this is acceptable...what if they lie and don;t give all the information about what they charged. What would be a good way to put this in writing.
Thirdly, how fast are they at sending out the statements??? Are they dragging out for the full 40 days??? Are they paying out in full??
if you go into the templates section and grab a SAR request letter and amend to your satisfcation, slip ten pounds in to cover administration costs and that is the maximum you will have to pay! I think you got MBNA's customer service team that really arent kept up to date on MBNA issues, if you want all of your statements for the past 6 years then request it, as you SAR will request all data processed by MBNA, i know on the odd occasion when i had a zero balance i still got a statement!
with respect to the 40 days, i think it differs with everyone, sadly i had to go the full 40 days then chase up daily. with respect to paying out, again i have heard MBNA offer a gesture of goodwill at the SAR stage (i didnt get one!) and also at the prelim stage (again i didnt get one! nasty MBNA :P) do they go to court? from other people's experiences they do not, they do not even like to get past the lba stage as its becoming quite expensive, but i am hoping to get my day in court, as i would love a judge to work out just how much their charges should be

I got a reply from MBNA today, I had sent them a (S.A.R - (Subject access request template from this site), and they have just ignored it, they cashed my £10.00 cheque and then told me that they were sending it back. They have sent me copies of transactions and offered me a £110.00 payment to go away at this stage (third of what they owe me), they then said that if I want full information, I will need to send in a S.A.R - (Subject access request) and proof of my id, photocopy of passport or driving licence, they have sent me a form to fill in requesting the relevant information.
Its just stalling tactics, I will be firing off a letter to them next week, as they will shortly be in breach of the original S.A.R - (Subject Access Request).
If there was no activity on any given month then a statement would not be generated as there would be nothing to show, believe this to be the case for most credit cards.
A statement showing a nil balance is not the same thing as this could show a payment you had made to bring the balance to nil, so there could well be months where no statement exists
Thanks for your replies...I'm happy to settle for a list of transactions as long as they don't con me and this has been the norm for everyone else in this situation. Just didn't want fobbing off if everyone else are receiving all statements.
I do intend to take them all the way with this and will enjoy doing so because of all the harassment way back then!
Just won back a claim from HSBC so feel a bit tougher now and know a bit more of what to expect!

They have offered me £420 as a goodwill gesture, on the basis that this is in 'Full and final settlement of my complaint'. I have not sent them a complaint letter yet only a S.A.R letter! Can they offer me this settlement?
They also state that they 'disagree with OFT's interpretation of the law'.
I will approach them again requesting the full amount.

In my experience whilst tackling HSBC, they will call your bluff and hope you accept their offer. I would write saying you accept their offer on the understanding that you will continue to pursye the remainder. Hsbc wrote something similar to me with their offer but saying they will refund me but without admission that they are in the wrong.
They think you don't know what you are doing and will try to put you off.
Stick with it!
