No response to SAR. Phoned Complaints Line (thx BankFodder for no.). Spoke to Helpful Heather - no SAR rec'd. Why do I want SAR when my a/c has no charges on it? Would like Halifax to comply with SAR. Call Trinity Road - number no longer in use. Called Complaints Line again & spoke to Nicola - happy to send 'FOC' copy statements. No - want SAR as per my letter. Not rec'd by Halifax. Chq 4 £10 was enclosed - but not cashed. Sent Rec Del - confirmed receipt on Royal Mail website - Halifax not rec'd. Will have to start again, says Nicola. Should I go immediately to Template 3?
If you sent by recorded delivery and it has been confirmed as delivered, what did they say to this? I had the same issue and when i mentioned recorded delivery, they suddenly became more helpful.
If they haven't cashed the cheque, it's possible that it has been lost in their myriad of departments. They didn't cash mine, so i ended up requesting the statements from their Customer Relations team (contact details are stickied in this forum) and cancelling the cheque - the good thing about this is that it cost £5 rather than £10
If you have proof of receipt, you can twist their arms to get the statements - don't hesitate to ask for a manager and twist their arm if you're not getting the answers you need.

Unfortunately for me, advising 'em sent & rec'd by Rec Del didn't make 'em budge! Sent non compliance with S.A.R - (Subject access request) let today by Rec Del pointing out to 'em, quite helpfully on my part, that i had sent 'em the chq for £10 & that i have proof of delivery, therefore, as far as i am concerned they have had their 40 days to comply. Also, I have photocopy of chq as well as all the other proof. Let 'em bring it on!
Advice needed please. I have read the FAQ's re SAR non compliance. Halifax have ignored 2nd request! Without the statements I don't know how much they owe me & as they have refused to supply 'em, I don't see how I can submit an N1. I sent Template 3 requesting info in 7 days, ZILCH! (the bird!). Halifax are well out of time, 2nd req sent 29/12/06! phone calls have not assisted. Do I now send Lett of Complaint to the Data Protection Controller? If DP Controllers have a backlog, is this another stalling tactic by Halifax to freeze me out? Any suggestions would be welcome.
I read another thread earlier today where this happened to someone else. They called the Hx head office and spoke to someone there, with the result that their statements are being sent out.

Yeah that was me. I mentioned that I had sent my DPA/SAR request three months ago, also informed them I had proof of sending etc.
The lady spoke to the complaints department for me then came back and said that they would issue me with 6 years worth of statements within 3 business days.
If they turn up and are all present and correct then result!
Thx 4 all your replies. I don't feel that I should be telephoning 'em though. I am minded to file an application Form N1 at Court 'cos complaining to the DP Commissioner takes too long. Any1 done this?
Does any1 know pls if there is a fee for sending the N1 form to Court 'cos i know fee is payable if claiming back a money claim, but not sure what to do when complaining to Court that Halifax hasn't complied with SAR. I note AlanfromDerby's templates where he states that the Court is usually quite hard on organisations who are obstructive, such as Halifax has been with me. I telephoned the Data Protection Team on Friday & spoke to a gentleman who, although I pointed out that I had sent all correspondence to them Rec Delivery & had proof via Royal Mail that it was received & Halifax now in breach of DP compliance, he really couldn't have cared less - will investigate your complaint whenever & respond to you. Asked when that might be, and he said he didn't know! Or more to the point, he didn't care. So I would really like to make the application to the Court ASAP if any1 out there can assist, pls!!!!
Just to say rec'd Halifax statements, but the envelope was already opened & not all statements were included, the earlier ones were omitted I have only rec'd approx 6 yrs statements. Will write to 'em asking for ALL statements relating to my a/c with 'em. Due to storm damage & having to work long hours I was unable to chase up Halifax, but I have a contact name now. It is Melanie Smith, Team Leader, Customer Services. Has ne1 had any dealings with her?
