    Default RicardoDiaz v Natwest **WON**

    Morning Folks

    New on here but am starting the process. I bank with Natwesticon and have had lots of charges over the year.

    I rang the bank asking about who I need to speak to about getting charges they said they could order my statements for a fiver then put me through to someone else who said they will send my details of my charges and refunds free.

    I am thinking I should write the letter as this might be the bank trying to get me to play their way rather than the way stated in this website.

    ALSO my cousin is doing the same thing with another bank but they told him he doesn't need his statements and to write to a certain department asking for the charges which he did.

    AGAIN I am worried this might be a bank tactic for them to try to get you to play their way.

    Any suggestions?

    Hi and welcome to the site,

    You've definately taken the first step into claiming back what's rightfully yours.

    Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the templates libraryicon as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

    Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

    Once you start the process of your claim remember to open a thread in the relative bank forum, this will enable you, and others helping you, to keep track of your claim.

    Yes i would say from personal experiance that this is a standard stalling tactic. Personally i would send in a SARicon to them but then its up to you. You may have to call them abit and chase up the requests.

    My advice is only my opinion, I am not a legal expert.

    Have done a bit of research and am thinking I am going to write the first Data letter asking for the info. Although they said they will send for free I think I need to follow every step as some of the people who are having difficulty seem not to have followed properly.

    Recieved my statments over the Christmas break and was astonished that from jan 2001 to date I have been charged £2,797 in Unarranged borrowing, returned direct debits & card misuse fees.

    One thing I noticed that within 1 year I think from 2004-2005 they doubled their unarranged borrowing fee from £14 to £28.

    They also put added this to my advantage gold account fees which made it harder to notice.

    Natwesticon have a special department set up called the Customer relations of about 10 people who if you get through to them on the phone sent my statements for free.

    Am going to send my first letter over the next week.

    Please make sure you send the prelim to Customer Relations Unit in Borhamwood as Branches no longer deal with charges letters.

    Cheers Sent it to CRU cliaming my charges with interesticon. Just over £3500.

    I am about to start the process with my joint account with my wife. Do we both need to sign all the letters?

    I now need to get my credit Card statements from MBNAicon, HBOSicon, & Capital Oneicon.

    This time next year I'll be a millionaire!

    Quick Question. The dealine for Natwesticon is Monday 5th Feb for my first letter. I have recieved a letter saying they are looking into it. I am preparing my 2nd letter in preparation for getting no response.

    The interesticon I am claiming would go up a little bit every day to I keep changing the interest or use the interest I am claiming in my initial letter.

    I am thinking if I re open the excel file it will update the interest. If it goes to court I dont want to submit fees that are different if I am not supposed to.

    Hope that sort of makes sense.

    as far as i know you can keep adding charges right up until you file with the courts so would imagine it would be the same with the interesticon you are claiming

    I am not an expert at this, any advice i give is from reading posts on this site, its all in here somewhere

    Just sent off my 2nd letter (The one before court). They sent me an acknowledgement of my first letter but haven't yet replied. Another 14 days and I will sue them.

    As it is now feb I have still left in charges from Jan 2001 I assume this is right as I raised the disput within the 6 year period.

    Yes that is correct, the six years start from the date you issued them with your preliminary letter.

    Just rang the Customer Relations Unit and apparently a letter will be out to me by end of the week with an offer for my claimed amount less interesticon for around £2800.

    Think I might accept!

    Just rung the CRU again this morning as still no offer letter. Natwests last day to comply is tomorrow before I am supposed to sue them.

    Been told that I should be recieving my offer letter any day for £2800. Should I sue them or just assume it will come through in the next couple of days.

    RIGHT!!!

    Natwesticon's time was up yesterday! Have rang CRU again and a letter is coming out to me for my claim less interesticon.

    Apparently Natwest have a 3-4 week backlog for looking at peoples claims.

    Once they devise an offer this gets sent to another department who drafts a letter who also has a 2-3 week backlog.

    Been assured I would have my offer by Next Wednesday (I think they know that that is when I get paid and dont have any money until then)

    They said that everyone who writes gives them a deadline, they do their best to keep to it but because of the backlogs it can take longer. If people take their claim further then they just have to live with that!

    WHAT DO I DO NOW?

    Do I wait? I can't afford the court until next week.

    Some peoples claims have been dealt with by Shatwest before even getting to lbaicon.

    Still no letter from Natwesticon. I get paid on Wednesday so can afford to file my claim to the courts. BUT was wandering the following:

    if I recieve their letter after filing a claim can I still get the court fee from them?

    How long does it take once you file before your you get a hearing date?
