I have today received a letter from BoS with the usual standard mince
" like other organisations we incur costs for every transaction made. When we pay an item against an unatuhorised overdraft or return item unpaid we incur extra costs. We beilive it is fair......blah blah blah
They go on to say how their costs are fair and clearly outlined in the terms and conditions fo the account........ and so on.
I have some questions regarding this
1. should I accept it and save the hassle of making claim in court for an additional £63.
2. I would also now like to start on credit card late payment fees on Halifax credit card. If I take this 'full and final settlement' will that prevent me from making a claim as they are the same organisation.
3. finally they have also sadi that they 'reserve the right to close my account if I don't manage it correctly'-the calim was on my own account but we also have a joint account with them, would they close them both?

First of all I think i would accept the £747 as Full and final settlement of the account in question.but it is your choice as youwill get interest if you go to court. That way you can do credit card with no worries i would have thought.

It depends on whether you want the hassle of going to court. I personally would accept it as final settlement of this account but not of any future claims you may have with other accounts. Make that clear when you send the letter accepting the amount.
Regarding the closure of your account. Any bank can close your account if you do not manage it properly. I think the banks will be getting pretty tough on this now bearing in mind the amount of people that are claiming charges back. Best to keep within your overdraft limits etc., etc., and give them nothing to complain about. Alternatively, you could change banks and start again. I wouldnt imagine that it would matter if it was your sole account or a joint account. If the acounts werent being run properly and the bank can't charge the unlawful charges, they will close the accounts as it is not profitable for them to keep them going.
If you are going to settle make sure they know that it is only this account and claim you are settling.
