About five days ago my girlfriend parked up around the corner from our flat.
It wasn't there this evening. Turns out they towed it. I don't know why and I didn't get a letter or ticket. The guy at the pound said to get it back its going to be £350. £200 penalty and £25 a day storage. I would have picked it up straight away if they had called.
Anyway, I read alot about getting out of PCNs on the other threads but I still don't know how to handle this. As I don't have a ticket or letter informing me. We need the car so I guess I have to pay up. Any chance I can get it reduced or claim it back?
Last year after being late in renewing my residents parking permit on the last day, a Friday, I got a ticket on Saturday, one on Sunday and a third on Bank holiday monday for parking in the same space outside my house that I have parked in for 10 years. As above, I was not causing any kind of obstruction.
Just after they issued the third ticket a tow truck turned up - all because I didn't have a permit and couldn't get one because the office was closed for the weekend.
What makes it a complete farce is that the bailiffs can' tow it, if it gets to that stage, yet the council CAN tow it long before it gets to that stage!
I have 14 days to pay or appeal, yet on the third day they come along to tow it before I have even had the time I am allowed by law to appeal against the ticket!!! How the hell can this be legal?
I wouldn't mind but I still had to pay the full amount for the residents permit the next day anyway so it's not as if they were losing anything because I was a couple of days late.
Well we are off down the car pound. We are going to pay I suspect, because there isn't any point talking to the power trip desk jockey that they will have running the place.
This £25 a day business really does force you to cough up, without appeal doesn't it. Sounds like they learned it from a mafia [problem].
Ok, what a surprise the scum at the pound were unhelpful and even had the nerve to talk to us like we had assulted someone, grrrr. They had out lower fines for criminal damage. Interestingly the pcn they handed us seems to be quite vague about the reason . Anyway I will ask this question of your combined genius. what could "Parked in a restricted street during perscribed hours" mean? cause my zone G permit was clearly visable. And the missus swears she parked it legally. So maybe the "contravention" didn't occur?
but unless my sense has deserted me the restricted street they refer to I have a residents permit for! So surely the contravention didn't occur? note that they first saw my car at 17:41 and oh! 17:48. I'll tell you the police have a slower response to muggings (read real crime) in my area - maybe less traffic wardens (read scum/tax collectors/I could go on but sadists is where I would leave it) and more coppers are in order.
Next point would be that in fact my car is gold not silver as the PCN states enough to get my £325 back (the car isn't even worth that).
I agree with every word, and it has to stop. You HAVE to get an appeal in to NPAS, then claim every penny back plus expenses. As you say, criminal damage carries lighter penalties and there surely must be a law somewhere that covers the injustice of it all, especially the fact that you have to pay up before you have even had the chance to appeal.
