    Default Shineygoldenmonkey v NatWest..... gulp! ***WON***

    Right i've read up on the FAQs and have read some case examples and am now feeling confident enough to start my claim, although i have read the FAQ my simple mind has some un answered questions.... (im only 20 btw) the majority of my bank charges are caused by me not having enough money in my account for DD, but i can still claim all the charges back cos there un-lawfull right? just am abit worried about that fact going against me... i will be posting the request for past statements letter tommorow, the data protection one.

    Thanks i have read it but it doesnt really answer the question im asking, basically i have a £350 OD and have been in it for some time, practially living in it, for example i was being paid £175 a week, i had to spend that to pay bills and ended up just staying perminatley £125 OD
    My question is, everytime i dont pay a DD the bank charge me £38 straight away, then an additional £40 at the end of the month, i the last 3 months ive had £330 in charges, and i can claim all these backs without any problems even though there my fault?

    You have not read the thread correctly because I now know you have an advantage gold account which is £12 of the £40 and the remainder is Unarranged Borrowing. If you have an advantage Gold account then I can save you £144 a year with one piece of advice, convert it back, it is not in your interests to have it.
    Yes is the answer to claiming back the DD charges

    Oh i get it now, sorry my bad... i have had the account changed back to standard now, as a Natwesticon member can you answer this? my credit rating was shown to me by the bank manager as 10 on the screen, is that high rating a result of my exceedibg overdrafticon charges? and that is called defaulting right? if so i can have that changed back down cant i?

    yes the account is risk grade 10(scale is 1 to 10) Yes it can be changed as the account is run without charges, ie when things get back on an even keel

    No a default is unlikely to have been issued and the person should not have shown you the screen anyway as at the top it would have said Pre Assessment screen (Bank Confidential).

    ok's thanks for your help, just one more question, on the preliminary approch for repayment letter should i include the defaulting part or leave it off? im guessing if the risk assessment is my fault then dont need to mention it?
    my problem is a really need a loan but cant get one untill that risk level thing goes down till about 8 i think the lady said. to get it to drop my account has to be run for 3months without a charge, that correct?
    sorry for being a pain but i really appreciate your help

    You can mention defaults but have they issued you with a default? Yes is the answer but the money you may now get back maybe quite a bit?

    I cant imagine my claim being more than £500 but thats £500 i didnt have before, as for defaulting i dont know, is there a way to tell if you have been defaulted?

    Thanks for your help with this everyone sorry took so long to reply have just been rushed around like mad!!! you know how it is......

    Right i have started phase one of my claim!!
    I sent the DATA protection act letter by recorded delivery to the main office in london all for the grand sum of £1

    looks like i got a 40 day wait now...
    Any tips for getting it to move along faster?
    any tips appreciated!

    Cheers for that info, il be interested to see exactly how much they have taken over the 5years banking i have done with them....hopefully a nice chunk of money!

    Will keep you posted on the progress of my claim, just gotta wait till the 12th of febuary now...

    A bit worried now.....been reading through some cases and everyone seems to send a cheque for the £10 maximum charge....i however sent a £10 note in with the letter....please dont tell me ive ballsed it up already?!!!
