I have just started the process to recover charges from Nationwide. My wife and I had accounts 4 years ago. I have requested the statements via standard dpa letter and have to say that these have been swiftly sent in a neat binder and with no charge. The charges amount to around £1500 just for my account ( I will do my wife's later).
I am now moving on to the next stage where things get intertesting.
I have £1008 worth of charges from a period between 2003 & 2005, mainly exceeding overdraft limit charges and unpaid cheque charges. I originally route to Nationwide back in March and received all of my statement etc in a nice folder. I sent my first letter requesting refund of the charges back in May and they wrote back bog standard letter saying that I agreed to the terms conditions etc when I signed up. Sent lba letter in July and received a reply on my return from holiday last week
Key words "We are comfortable that Nationwide has been completely open and transparent about our fees & charges making it very clear that if you exceeded an agreed overdraft, went overdrawn without prior arrangement ----" They have said they will not be re-funding any charges.
Next stage - Legal Action, I will fill in the form on line today using your template and see where this goes.
This looks like the standard path Nationwide are taking with customers at the moment can any one advise next steps.
Go for it Barry. They won't pay up unless they see that you're serious enough to start an action, and they will acknowledge it and say they're going to defend - but about a week later, the money will magically appear in your account. I've just checked mine and it's there - £2500! That's just the claim, but I understand that the interest and costs go in separately.
So it can be done, and the relief when the money arrives makes it all worthwhile

Question, The account was closed in 2005, so I am claiming for charges levied on an account now closed. Is the 8% interest still applicable, I am unsure as to wether to add to my on line claim or not. If this is about interest I have missed out on by not having the money thay charged me than I presume I claim, if it is about intertet thay have charged my by taking the charges out of my account than maybe I can only claim untill the date the account was closed.
What address for Nationwide should I use for the legal action, is it the Charles Bacon one ?

Yes to both questions. Don't put Charles Bacon's name on the MCOL form though, just Nationwide.

Have been contemplating where I am, I noted on the money claim site there was no where to put the Breakdown of the money claim ie copy of spreadsheet, also I have not put an account reference in, I note from previous threads that over claimants don't seem to have this in the particulars of their claim either.
The account number I put in the reference section - if you ring MCOL Helpline first tyhing they will be able to amend your claim for you for free as it won't have been submitted by then. Breakdown of charges will be fine

also consider yourself lucky, we don't have MCOL in scotland, poo theres me chip on the shoulder kicking in

Withdrew claim this am, Money Claim lady very helpful.
Tonight amended claim to include acc. no in reference also changed wording in particlars to some recommended in previous threads.
Also reviewd statements and previous letters and note that I should be claiming 1257 which goes back to 2001 (still within 6 years) but 5 years of interest at 8% is in excess of £500
Submitted claim on line tonight and will now see what happens.
