Perhaps if you were to report it to the police, and thats if they listen of course. You may be able to get a crime reference to take to the DSS. That way they can see your being legit and maybe continue your claim as well as investigate it themselves. They shouldnt really leave you with nothing to live on although of course, they often do...

    I dispair of the DWP

Doesn't the right hand know what the left hand is doing. Isn't it supposed to be the case that all our benefit data being combined on one system is meant to combat precisley this type of fraud

Keeping Benefit Data on one system will not stop Identity Fraud. At the moment Tax Credits are paid by Customs and Revenue, Other benefits, such as Disability, Incapacity Benefits are paid by the Department for Work and Pensions.

I work as a Fraud Specialist for DWP and I am always amazed that some of these double benefits are not picked up quicker than they are.

If you have no joy after the interview, my advice is to write to your MP and insist he/she investigates. Believe me, all hell breaks loose when an MP letter arrives.

Unfortunately, the original poster has not replied. Their interview was on December 14th, hopefully something was sorted out for them by the investigators?

Why is the money stopped until after it's investigated leaving them often without food. Why is everyone on benefits treated as if they are guilty before proving themselves innocent.

Neither do I wish to be unkind to DWP staff. They do a hard job under circumstances that can often be 'very trying' on patience and temper and deserve all credit for what they have to put up with sometimes.

However, the one big difference between DWP staff who are victims of ID Theft and their 'customers' is that they (DWP staff) still have their own salaries coming in, whereas the 'customers' frequently don't have any other source of income.

Jimbo 44 - always happy to help, but always willing to learn from being corrected too!!! Whilst any advice given may be based upon personal experience, please always be sure you seek guidance from a professional in the particular field.

Never be afraid to try something new. Remember that a lone amateur built the Ark, but a large group of professionals built the Titanic.

A 'click' on the scales is always appreciated if I have helped. Many Thanks!

that was one of the questions we asked. we wont be 100% sure untill it has been checked out, but we do know the person who was claiming was only using the correct N.I.N and name, they had the wrong address and DOB on file, so the chances are we shouldn't have any back lash from this.
about the staff, i can say we only had problems with one person and that was a man in the local JSA office, he was as unhelpful as could possibly be rude and was pretty much saying it was our fault for not working in the first place (we dont even get JSA). however he was only one out of many we people we spoke to.

    Hello,

This has just happened to me - I'm in shock, I just got home and found a "Notice of Legal Proceedings" letter in my mailbox, stating that I have to pay over 600 quid to the Inland Revenue due to "Working Tax Credit overpaymenticon", or they'll take me to court!

The thing is - I HAVE NEVER CLAIMED Working Tax Credit! I have worked full time since leaving university 9 years ago and have never claimed any benefits at all! I pay my tax through PAYE and I have every single payslip I've ever been given to back me up.

I am really shaken up and I won't be able to get onto the phone to sort it out until Monday so I've got to go through the rest of the weekend worrying about it

This is the first letter I have had about anything like this, which makes me wonder if it could be a computer mistake? Surely if someone is using my identity, the correspondence would go to their address?

The thing is, about three years ago someone stole my identity to obtain credit cards. It was supposed to have all been sorted out back then, but now I am really scared that this person has been claiming benefits under my name ever since! I went to the police back then so I think I still have the crime report number somewhere about.

Please has anyone got any advice for me??

    Thanks!!

    Oboe

You have absolutely nothing to worry about as you have done nothing wrong and you have the paperwork to prove it. Just contact them and explain. If you have the crime report number for the identity fraud, all the better. If not just refer to the police station that you reported it. Write a letter to say all you have just said, telling them you have never claimed working tax credit so they need to look into it.
