Default Synaptyx Vs Alliance and Leicester

I've just posted my SARicon with a cheque for £10. I looked at this a few months ago, but didn't do anything about it. I am so glad I found this site, the amount of useful information is staggering. When I get my money, I'm going to restore my VW bus.

Hi and welcome to the site,

You've definately taken the first step into claiming back what's rightfully yours.

Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the templates libraryicon as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.

Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.

All the best in your claim!!

By my calculations A&L have 8-9 days left to reply.

Is it usual for them to take up to the last minute?

    Hmmm...

    Hi all!

This is the letter I received today from A&L
Thank you for contacting us regarding your account.
I have noted your comments that you believe the charges that have been raised on your account to be unfair, please be assured our charges are reasonable and are competitive with the charges made by other financial organisations.
The Office of Fair Trading (OFT) has commented that they consider the level of late payment charges to be unfair, however they were actually referring to late payment fees for credit card payments, which are quite distinct from a bank’s charges on current accounts.
As yet, the OFT have not entered into any discussions with the banking industry regarding current accounts. However, should that position change in the future, then Alliance & Leicester will participate as appropriate.
Oiven the above, I cannot accept you have been unfairly charged as you suggest. I regret, therefore, that I am unable to agree to your request for a refund of charges on this occasion.
I am sorry if you are disappointed with my response, but as the charges have been raised correctly in line with the terms and conditionsicon of your account, they must stand.
Anybody tell me if they got the same letter? Next step lbaicon!

Sounds like their usual blurb, synaptyx. Just keep on with the tested formula and ignore anything they send you - unless it's a cheque!

Ok, the lbaicon has been ignored. I assume I can't use MCOL because I live in Scotland? Will fill in the court forms this week.

Your reply before you sent the L.B.A.was nearly word for word like the one i recieved but they have offered a "goodwill"payment of £25.00.
Which of course i will e-mail back thanking them in part payment and not accepting the "conditions"they quote.
Keep plugging with the l.b.a. stuff i think your next step is to file a "moneyclaim"as you have given them the"28"days.
    Check the library/Threads to makesure.
    Lancsman.
P.s.Suppose i should start a thread as ive "started"on them

JUDICIAL INTEREST AT CURRENT RATE OF 8%: £8.73

TOTAL CLAIMED AT DATE OF JUDGEMENT OR PAYMENT: £466.74
I'm a bit confused by a section in the court claim:
    c) The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year, from [date when the money became owed to you] to [the date you are issuing the claim] of £ [amount] and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of [enter the daily rate of interest]
Can somebody please unravel this one for me? I'm really lost at this point.

    Thanks.

    Hi Synaptyx,

I'm at the same stage as you, i'm off down the court tomorrow to file my claim.

My spreadsheet looks just like yours! How i've interpretted it is that the 'Interest' column on the right hand size IS the 8% judicial interest you should add, and not the overdrafticon interest - as far as i'm aware if you are working out the overdraft interest you have to use a different spreadsheet. I'm not bothering with the overdraft interest for mine as my claim is quite small (£375) compared to some and i'm sure the interest would be too as i was generally only over my limit for a day or two.

I would double check on the FAQ's but i think then that your £33 is the Judicial 8%. Thats how i'm doing mine anyway...but i'm quite new to this and will probably be proved wrong

The weird thing is the spreadsheet calculates my judicial interesticon as £8.73. Is that right, it seems a bit odd.
