Just wondering if you can claim charges on an actual loan as opposed to a HP agreement.
I've had a couple of cash loans from BH over the years (can't actually remember if they charge late payment fees but thought I'd give it a go!) so sent off a S.A.R - (Subject access request) on 17th Nov and this was the reply:-
"We have recently received a number of letters,all worded exactly the same as that received from you,(am i interested- I think not!) where the prime purpose behind requesting a copy of the information we hold seems to be to dispute the additional charges applied to an account.(I know-I told you that in my letter!)
If this is the purpose of your request, whilst we are happy to provide a copy of the information we hold, the production of such info will not serve any real purpose in detailing when and why the additional charges have been incurred.(surely I have the right to know what I've been charged for??)
We are aware of the recent instructions from the OFT in relation to additional charges incurred through late,missed or unpaid payments,however, this instruction relates only to charges incurred aganst credit card agreement debts. As our agreement with you is not such an agreement, the instruction from the OFT does not apply( is this true?:o )
If you do have a query regarding charges applied to your account, it will be easier and quicker to discuss these with us.You can do this by calling the number at the head of this letter(not a sniff!!) where we will be happy to discuss matters with you or write to us setting out your rationale for why you are disputing the charges la la la .....
