Well sent them as first request letter on 6th for £361.11. Only held account since Mar 06!!!!! Does Nationwide pay up quickly or do they like a fight!!! I am in need of a good scrap lol.
no need to be worried gillytilly - NW play the waiting game and won't pay up until you issue court proceedings against them.
So, send your lba 14 days after your prelim and ignore any letters that say "are charges are fair and transparent" or "no" - then 14 days after your LBA issue your MCOL or N1 form - just follow the step by step instructions and you'll get your cash back soon enough - good luck and keep us informed along the way

Right, got home today and recieved a nice letter telling me that "I have been unsuccessful" blah, blah. Roll on the 20th as they are going to get some lol!
gillytilly - what are you worried for? We've all been there. You just need to read up and be aware of what you're doing - follow the step by step instructions and you'll be fine - remember YOU are taking them to court - not the other way around

As you've only issued a preliminary letter, do not go straight to court on the 20th. You first have to warn them that you are prepared to go to court by send your lba. Do that on the 20th. give them another 14 days, by which time you will get a reply again saying we appreciate your concerns, blah blah....., but actually we won't give you any money back so you could always bank elsewhere if you don't like it.
Then do your MCOL. I did mine on Monday, MCOL issued on Tuesday, so now a waiting game for me. But you must give them the 14 days each time.
Thanks tonkyboy. Well, are they sneeky or what. I have been charged £90 for 3 returned DD's (my fault i am in the process of switching accounts - opps) and they have put it on my statement as "interest"!!!
Is that they way they are trying to stop from claiming back, anyone else got this problem???
They charged me for 8 returned DD's a few months ago. Nationwide had actually froze my flexaccount for THREE WHOLE WEEKS at the time my DD's were getting returned...even though I was more than £1600 in credit!!!...
My crime was that they had unilaterally cancelled my maxed out £3000 O/D a couple of months previously. I had then told them that I was going to pay my higher % unauthorised O/D off first...before I made any more payments to my lower % interest personal loan and I had refused to re-set up a cancelled DD to Nationwide Trust until then.
I was due to catch up on my personal loan the very same day that they froze my account!
Even after they unfroze my account, I was treated like a leper...my flexaccount was downgraded to a basic current account and for the first month I had to go to a branch to withdraw any money!...
The fact that on my statements Nationwide had put down the unlawful Returned DD Fees as "INTEREST" stood out like a sore thumb in my case cos there was no other activity on my account!!!...
The £30 unlawful charge should be pretty obvious to anyone else who looks carefully at their statements though, as it's too precise a figure...normally interest shows as £'s and pence.
Hope my post re-assures U that U aren't one that this has happened to gillytilly?!

Well, i have posted the lba today and have given them until 12th Jan 07 due to bank holidays etc!!! We will see then all hands to the pump and lets get them. As they charged me £90 recently i have asked for that as well, is that ok!!! I included a print of my charges and sent it recorded post. Fingers crossed
If they charge U again once U have had to file your claim at court...and even if after they have settled in full...

I just don't know WHY U are allowing them their Bank holidays to delay U???
Getting their UNLAWFULLYimposed charges back to U asap shouldn't have to depend on what days off they have...surely?!
Do genuinely hard up people STOP worrying about their inability to pay their overdue bills just cos it's Xmas???...
How many people's Xmas will be blighted cos they are unaware that their Bank owes them £000's???...

Sorry for long delay in posting a reply, but ive been away. Many thanks for your comments mtm, but these are public holidays not just bank holidays. I know what your saying and you are totally correct, but unfortunatly i have posted the letters and they have been recieved on the 21st Dec 06. So, i will file my MCOL on the 12th as i instructed them and recalculate my claim to include interest, but it wont be much.

I'm currently in the same predicament as you as my lba was signed for on 15th December 2006 and I was not sure whether to just allow the 14 days or add on extra time for holidays etc.
flex account showing 700.00 account balance on opening screen yet when statement comes up only shows 3.00 what are Nationwide doing with the money why cant i access it
Kittycatt, i only gave them the public/bank holidays cause i was naive. I think you should give them no lea way, just stick to the time frames set out on this site and everything will go swimmingly. Once Nationwide has been issued the MCOL they tend (on other threads) to cave in and pay up. They also close your account, so prepare to switch.
This might be another delay tactic. The only thing i can suggest is if you go into you branch and demand to know why it hasnt cleared (it is your money).
I wonder if anyone can advise me. I gave them until 12th Jan 07 (coz im soft) and they have already writyten to say "no" blah, blah again. As really the 14th day was yesterday from the lba, can i now start MCOL action.
