Hi everyone I've just joined. Looks like there are loads of people finally claiming. I've started the process already but hit the stage of deciding to accept an offer or go to court. My dilemma is the Halifax/Bank of Scotland has offered me £650 I'm entitled to £1200. My understanding is that halifax is based in scotland and I can only claim £750 is it worth going to court. I going to try and search the threads but if anyone has any advice please let me know. Thanks. After this claim I'm going for the student loan companies heehee.
I am also claiming from Halifax, they owe me £217.00 not counting interest and they have offered me £150.00. I want to accept but my husband first said we should claim full amount but now is not so sure. We don't want to have tehm closing our account and asking us for £2000.00 overdraft back.
It's a pity that you're not a sassenach then you could claim through the English court system.
Split the claim into two parts. Put the first claim through and when that is settled, then put the second claim in. (Make sure that the two claims are not overlapped otherwise they may be combined by the courts.)
That way You will get ALL of YOUR money back.
Go for every last penny that they have taken in penalty charges.... it's YOUR money. The bank will want to use the payback to offset and reduce your ovedraft, but it is possible to specify how you want the money to be paid to you.

Check out Summary cause, it has a limit of £1500. Not too much different from small claims.
Lilacj Ive had 1 sm claim + 2 Summary cause settled against this mob, waiting on my next action being settled at the mo, still have my account and my £500 overdraft intact.
