Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am helping a family member win back there money from Abbey and after reading lots of threads i cant seem to find the correct address to send off the Prem. (Have got statements as they were kept) Might do a SAR anyway to see what else comes up, as there is also a credit card which has had charges placed on it.
Please help with the address, and any info would be very welcome.

Hi all, I have a quick question that i would be grateful if someone could answer. As you maybe aware i am doing this for my step mum, but she has major concerns about what Abbey could with regards her mortage. If she takes Abbey all the way to court and they refund her charges on a closed account could they close or ask for a re payment in full of her mortage.
Please help Mark

Hi guys, sorry not posted for a long time been busy with other cases.
I have got as far as the Money Claim section of the claim and have just received a letter stating the Abbey are going to Defend.
Letter from Northampton Court Reads:
A Defence to this claim has been filed.
The claim has been transferred to the court covering the area where the defendant(crossed out and changed to Claiment) lives or carries on business.
Please read the accompanying documents carefully (--- and note that the allocation questionnaire should be returned to Barnstaple county court --) ALL CROSSED OUT ?????
All further comminiction should be addressed to : The Court manager, Barnstaple County Court etc etc
Could someone please tell me why this case has been moved to Barnstaple when my step mum lives in Eastleigh near Southampton about 4 hour drive away????
Also included is a letter stating:
IT IS ORDER THAT:-
1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise.
NOTE: Any party affected by this order may under Rule 3.3 (5) apply to have it set aside, varied or stayed. Such a party under 23.3 within 14 days of service of this order.
What do i do next???? Just waited to hear from the Judge ??
Received a letter from Southampton county court, so i guess the previous court have automatically passed it to them. Dated 15th June 2007
It states : IT IS ORDERED THAT
1. Claim allocated to the Small Claims track
2. Claimant to file and serve within 14 days of service of this order an itemised list of each and every charge claimed giving date and amount of each.
3. Defendant to file and serve within 14 days of service of this order a statement setting out all the facts and matters relied upon in paragrapth 8 of the defence.
4. refer back after 21 days
Dated 12 June 2007
I have sent a copy of charges to court and also to Abbey but have received nothing from anyone since so would like info on what i should do next????????? Deadline for them should be up by now, i guess????
Should i contact the court to see whether Abbey have responded???????
Please help, Thanks Mp
