For those whom are affected with this fee will know it is a pain in the `beep', however i think i have found where this fee originates in law, please feel free to correct me if i am wrong!

Hi all basically i define the meaning of clause as excluding fees for payment outside the total charge for credit, if (1 and 2) are false however if (1 and or 2) are true the fees are included in the total charge for credit, therefore their gross profit is out the window!
1: Except where the debtor does not have reasonable freedom of choice in the matter.
I define the meaning of clause as :
a:You dont have a bank account.
b:Your funding cycle is uncertain or changes month to month.
c:You have little or no trust in the supplier.
2: And where such charges are abnormally high;
I define the meaning of clause as being the costs compared to other payment.
Bank transfers, standing orders, internet and phone banking generally free from surcharge, but subject to the banks slush fund `The Float' for up to 4 bank days.
A debit card is mostly a free transaction, however a few suppliers may charge up to £1 per transaction and or per person as in budget flights.
A credit card has an average charge of 02.50% on the purchase, that is only £0.625 rounded up to £0.63 per month on £25 or £7.50 per year on £300.
Direct-debits when you buy insurance on a yearly basis the basic fee is total charge without credit for that year, you can pay that in full by the most methods you wish without incurring any credit fee, however they have on option to pay via 10 equal direct-debit plus 1 other payment.

a: Represents the cost of the total charge without credit per year.
b: Represents the interest rate with zero modification.
c: Represents the cost of direct-debit per year.
d: Represents the cost of the total charge with credit per year.
Now lets compare 2: it to Telewest's non-direct-debit fee of £4 per month on £25, it does seem a bit steep, but when it is compared against other payment charges it is blatently obvious it is a penalty or £48 based on an yearly charge of £300 seems to be a penalty or disguised penalty under UTCCR Group5 1e Schedule2.
In my case (1) is both (b and c are both true) as i have lost my income 7 times in the last 10 years and i have 100% trust in TW doing the wrong thing and 0% trust in TW doing the right thing!
