    Default Council Tax Arrears

    Hi,

    I am posting this on behalf of my brother-in-law as such i can only put the info i know of but if there is anything you require to know i can find out..

    Basically he is in arrears with his council tax, he had finacial difficulties at the beginning of the year, he is paying it now but there is arrears from earlier he tried to come to an agreement with them on how to repay it back but they refused his offer.... a little while went by and out of the blue baliffs appeared at his door he chased them away and heard nothing more until today he informed have arrested his next wage.

    Is there anything he can do to stop this, he has offered to pay the outstanding with a payment plan which they refused, and this time of year is tough enough without getting your wages taken from you. any advise would be gratefully recieved.

    Ok he has informed me that it is an earnings arrestment and apparently it goes on what you earn, so the more youearn the more that gets deducted....

    What the council have obtained is a Council Tax Attachment of Earnings Order (CTAEO). It is a mandatory deduction which the employer must administer based on a percentage of net (take home) pay. Don't quote me but I think (on a weekly system for example) it's 17% of the first £370 net pay plus 50% of the remainder. So, for example, if he takes home £400 per week he would have £62.90 (17% of 1st £370) plus £15 (50% of remainder) deducted - a total of £77.90. This will continue until the entire sum due is paid.

    He will need to check this with the council as there are specific tables depending on how he is paid (weekly, monthly etc). Also, the employer can, if he chooses, deduct £1 for adminicon costs in respect of each deduction.
