    Thumbs up court small claim summons forms (guide)

    When filing your court summons use the templates on the Scottish court site. They are perfect.


    The forms are very simple to fill in.
    You will need
    1) 1 x form 1 and 1 x form 1b (NOT 1a).

    2) Fill in adresses to a Scottish branch location not head office.
    scottish law only works (can only be pursued)in scotland.


    3)Example of the claim:

    "The Pursuer claims from the defender the sum of £***.** with interesticon on that sum at the rate of 8% annually from the date of service(together with the expenses of bringing the action)"

    4) Details of claim are as example in the library with the exception
    all references must be to: you-"pursuer" , them - "defender"
    add the list of charges to the details of claim .

    5) Make 2 copies of all attached paperwork one for the court and one to go to the defender.

    NOTE:if you receive working tax credits (other benefits too)your claim will cost you nothing to file, but you will need to show a tax credits award notice(recent).

    My claim with Capital Oneicon is for £1,200+ so do I fill in a small claims form or a summary cause form??

    Hiya! You need a summary cause form as the categories break down as follows:

    Under £750 – small claimicon
    £750 - £1,500 – summary cause claim
    Over £1,500 – ordinary cause claim

    The claim form can be collected from any Sheriff’s Court or can be requested by phone.

    The form will come with a helpful and easy to understand booklet which will explain the procedure. The fee payable to the Court on issue is £39 which you’d add to your claim of course! This fee can be waived if you are on benefits or your wage is particularly low but you’ll need to complete a fee exemption application form which can be downloaded from:

    7 Nov - prelim.
    3 Dec - LBA
    13 Dec - £750 offered
    23 Dec - £750 credited
    28 Dec - rejection letter
    2 March - issued
    16 April - complained at court failure to forward defence

    Halifax

    22nd September: Subject Access Request.
    4th November: No reply so LBA giving 7 days.

    Cap One

    22nd September: Subject Access Req.
    5th October: Letter saying no record of account!
    15th October: Replied telling them to try harder...
    22nd October: Subject Access Req acknowledged.
