    Default Please help-Small Claims or fast track

    Hi...
    Can anyone help...
    My bank charges over the year have amounted to approx 5.6k,I beleive that any claim between £100-5k can only be taken thorugh the small claims,does this mean that i hagve to go through fast track?

    If it does what does this mean and what will I have to do ?

    I have sent my before action letter and have been offered a meagre amount of 1.5k and have to sign to state I will never question charges again(bloody cheek..!!!)and am getting ready to issue in approx 5 days,please help as I felt confident in the smalls claims although little worried now if it has to go to anywhere else.

    Generally claims up to £5,000 are allocated to the Small Claims Track, claims of between £5,001 and £15,000 where the trial is unlikely to last more than one day are allocated to the Fast Track and claims of more than £15,000 (or where the trial is likely to last more than one day) are allocated to the Multi-Track. The Court does, however, sometimes allocate cases to a different track to the one normally appropriate for example a case which raises difficult questions of law may be allocated to the Fast Track even if the amount claimed is less than £5,000 or a relatively straightforward case such as yours may be allocated to the small claims track even if the amount claimed is over £5,000. This is one of the purposes of the allocation questionnaireicon, to give the parties the opportunity to indicate which track they think the case should be allocated to.

    In the case of the Small Claims track, less preparation is required of the parties (for example normally each party will only be required to provide the other party with copies of documents that the first party intends to use at trial and, unlike in the Fast Track and Multi-Track, not with every relevant document which the first party has) and the court’s pre-trial intervention is normally limited to giving written standard directions when the Allocation Questionnaire is returned by the parties.
