unfortunately the court ruling on this was that although some pcn's didnt comply with the date issue, PCN's that had already been paid by alleged offenders had in paying, admitted the parking offence and those already paid would not be refunded. So unfortunately it looks like a lesson learned I'm afraid? Check out this link below

fortunately the Banks cannot argue that point, with a pcn you have to send the payment off, whereas the Banks automatically debit your account without your permission, theres a subtle difference. If you send off a payment in relation to a PCN you are effectively admitting you was in the wrong and they will not refund even though the PCN may have been unlawful.
The Banks dont write to you asking for payment they just take it which in itself is unlawful, thats why we can claim back the Bank charges imposed on us.
