    Default Claiming £201, bank taken £700 from my account to pay credit card debts! help!

    Hi all, I am pretty desperate for some advice. I wrote to Halifaxicon requesting £201 bank charges from my Cardcash account back and received a standard 'Sorry to hear you are unhappy...hear from us in 4 weeks' letter on the 22nd November. My payday was the 23rd November and a day later on the Friday night i noticed to my horror £688 cash had been taken from my CardCash account! I rang the callcentre in a right state and was given Retail Bank Collections number who informed me it was to pay off my existing £1600 Credit Card debt (the limit is £1000 so charges have been incurred to the tune of £600) which i had defaulted on. The lady said this couldnt be refunded (fair enough this is my fault) and advised me to call back in a few days to agree a repayment planicon on the remaining £960 or so. I checked my account Wednesday of this week and another £20 had been taken! I rang last night and agreed a short term (3-6 month) repayment of £50 a month starting on 23rd December and they said no more money would be taken from my bank account but im uneasy about this- i have had to borrow £700 from my boyfriend to live and get through Christmas etc. The problem is do i continue my claim for my £201 bank charges as i owe them money on my CC- i dont want them taking the £960 after my next payday! Help!!!

    Hi Nichno,

    You might want to open another account for you wages to be paid into if you want to be sure that they won't take the money again. Have a look through the parachuteicon accounts available for those unable to open regular accounts.

    Unfortunately the banks are able to offset debts from one account to another.

    Do continue with your claim. It seems they have already done their worst to try to put you off.

    yes nicho as zoot says they have done their worst. Get your money paid in elsewhere asap. Also as there is no longer any urgency do not phone them put everything in writing & keep a detailed record of everything that has & does happen from now on.

    The default/penalty charges are unlawful no matter why they where imposed & they can either refund them willingly + interesticon or be forced to by litigation. Also I suspect you only went overdrawn all or in great part because of their added penalty charges. Am I correct?
