Today I received the defence from Cobbetts. It seems to be the standard version.
I will keep this thread updated over the next few days, in the hope that it will be helpful to others, in the process of the recovery of charges.

arrived today. Notice of transfer of Proceedings. A Copy of defence.
As expected.

Notice I have received a full refund of charges from the Co-op today after just a prelim. That was nice.

Onwards and upwards.

returned to court with schedule of claim recorded delivery. Copy of AQ to Cobbetts with another schedule of claim recored delivery.

The postage costs are mounting.

One letter from Smile confirming refund of all charges to my internet account (pre lba icon

)
One letter from RBS icon

with a cheque refunding all charges and interest icon

on my credit card (pre MCOL),
A letter from Cobbetts with a copy of Nat West aq icon

, excactly on the deadline, or and a couple of Christmas cards.

Cheque for full amount received 3rd Jan 2007 (approx £4500)
Almost done and dusted now, just a couple of minor issues to resolve and I will then provide more comprehensive details to this forum..

Just one small point though - you got your defence on 2 December and got paid in full (barring some small issues) on 3 January?

Did you get a court date?

Indeed, as you may know this is a business account so may have some relevance to others, and I will be happy to share the process with others in a similar situation.

There is quite alot more to this saga, and I am looking forward to spilling the beans. In the meantime there is the small matter of Lloyds icon

filed in October and I have yet to see a penny! The fact that it is a business account should not make any difference.

Now that seems strange. Have you chased up, it sounds as though there has been a foul up in the system.

Numerous times, there is incompetence in the system, this is Cobbetts were are talking about here.

There is a time critical procedure once the claim is legally made, and it is not possible to protract proceedings unreasonably. There must be a reason for the delay.

My court date is not until later this month, they have no reason to pay me any earlier than that day if they so wish - or (and I sincerely hope this is the case) they actually plan on attending...but I doubt it.

OK I would just like to confirm that this case is offically over, having received a full refund of bank charges and interest and costs claimed.

I would like to thank all who offered advice, the moderators, and the site itself which is quite outstanding.

I will continue to offer any advice or help based on my own experience as a sole trader reclaiming charges, and I will suport this site practically and financially.

Now for Lloyds TSB.

Good work,and thanks for your continued support.
Hopefully the Business claims will benefit from that.
We anticipate having a business thread that will address all the issues in one place,as a business claimant myself this is something I know needs doing.
Just a small point in question is the settled claim with RBS icon

or NW ?
Let me know so I can move it to the right section.
