Today I received the defence from Cobbetts. It seems to be the standard version.
I will keep this thread updated over the next few days, in the hope that it will be helpful to others, in the process of the recovery of charges.
The postman cometh,
One letter from Smile confirming refund of all charges to my internet account (pre lba)
One letter from RBS with a cheque refunding all charges and interest on my credit card (pre MCOL),
A letter from Cobbetts with a copy of Nat West aq, excactly on the deadline, or and a couple of Christmas cards.

Just one small point though - you got your defence on 2 December and got paid in full (barring some small issues) on 3 January?

Indeed, as you may know this is a business account so may have some relevance to others, and I will be happy to share the process with others in a similar situation.
There is quite alot more to this saga, and I am looking forward to spilling the beans. In the meantime there is the small matter of Lloyds TSB to be addressed.

I only ask as my defence was received and aq filed in October and I have yet to see a penny! The fact that it is a business account should not make any difference.

Numerous times, there is incompetence in the system, this is Cobbetts were are talking about here.

There is a time critical procedure once the claim is legally made, and it is not possible to protract proceedings unreasonably. There must be a reason for the delay.

My court date is not until later this month, they have no reason to pay me any earlier than that day if they so wish - or (and I sincerely hope this is the case) they actually plan on attending...but I doubt it.

OK I would just like to confirm that this case is offically over, having received a full refund of bank charges and interest and costs claimed.
I would like to thank all who offered advice, the moderators, and the site itself which is quite outstanding.
I will continue to offer any advice or help based on my own experience as a sole trader reclaiming charges, and I will suport this site practically and financially. Now for Lloyds TSB.

We anticipate having a business thread that will address all the issues in one place,as a business claimant myself this is something I know needs doing.
