    Default WE WON Mrs thesergeant v Halifax

    Dear all,

    We won, only a small victory but we won.

    We had accepted an interim payment, they were holding out on the contractual interesticon. May have been a slight mistake in accepting the pertial payment.

    However, another letter pointing out the closing court date illicited Full and finalicon settlement ............:grin:

    Thanks for all the assistance ........ Now its on to the next one ..........

    13/12/06 - WON!! £1000

    We got £201.00 in charges, £13 in costs, £50 court fee and £130 in contractual interesticon .........................

    The claim was increasing at 36per day, they did under settle by £8 due to that, but we didnt pursue that !!!!!!

    I've had a complete change of heart.

    I have just faxed a letter to the Halicrap informing them that they have not settled this matter as they have not paid the daily rate of interesticon ........

    I expect the outstanding £14.04 they still owe me before I will stop the court action .....................

    I refer you to my letter of 25th November 2006 and all previous communications and my county courticon claim form served upon you.

    You will note that there is, as is always the case in such matters, a daily rate of interest to settle such matters.

    You have not taken that into account when attempting to settle this matter with me.

    In the spirit of goodwill I will accept settlement as of my letter of 25th November. That being £109.39.

    That being the case there is an outstanding amount of £14.04, required for Full and finalicon settlement.

    Once this is paid into my account I will notify the Court and this matter will be satisfactorily settled.

    Dear all,

    Salt and wound well and truly rubbed in, Halifaxicon paid up the £14.04 daily interesticon today, that they had conveniently forgot when trying to settle with us.

    They had got so confused by everything that they first filed a defence stating they dont repay bank charges!!! Of course they forgot that they had already done that - I enjoyed pointing that out to them. They tried ignoring me for a while, that didnt work.

    So - WE WON AGAIN

    Thankyou Halicrap, All charges repaid with the addition of 29.8% contractual interest and costs .....................

    Survey done and thankyou payment made ............
