Hi all,

Wondered if anyone can help me please.

I signed up for a lease car from Capital Bank Leasing Ltd on 27/6/2002 for 3 years.

Anyway all went well until about July 2005 when the lease car supplier was not able to get me another car that I wanted... so I extended the original lease for the original car.

Then at the end of Sept 05, I got a company car, so I wrote to BOSicon who own Capital Bank Leasing and terminated the agreement and told them to please contact me to arrange collection.

Anyway, still insuring the car but off the road, with no road tax - kept ringing them to say I still had the car in my possession and what was happening, they were promising to ring me back - never did.

On 27th Jan 2006, i wrote to them again saying that no reply had been received and i was still in possession of the car, still no reply.

Next i get a letter from BOS saying i owed them £866.20 !!!
I wrote back explaining the situation and i had terminated the contract in writing on 28/9/05.

THEN they write back to say that the onus is on me to return th vehicle on 17/2/06 :o

All along I was just waiting for them to contact me and tell me this back in september 2005.

Today I have received a N1 Court Claim form from them for £1,754.16

Why should I have to pay this? I had paid them up to end of September 05.

Can someone please point me in the right direction please?

Thanks
