Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Sent off the DPA SAR yesterday along with the £10 cheque,
trying to keep absolutely everything in order,
made photocopies of the letter sent and made note of the date i sent it
unfortunately i forgot to send it recorded delivery, does this really matter?
i know i should of
just gotta wait 40 days now, woah thats in the new year
You've definately taken the first step into claiming back what's rightfully yours.
Spend time reading the FAQ's and the Step by Step guide as this will stop you making mistakes along the way. Use the letters and spreadsheets in the templates library as these have all been tried and tested in successful claims. Read as many threads as you can especially ones that relate to your bank. This is a SELF HELP site and won’t do the work involved for you. However, everything you need is on here somewhere.
Don't be afraid to ask any questions, no matter how stupid they may seem, but please remember that any advice that you receive is normally based on experience only and that you should seek expert advice if required.
thanks for all the awesome links
im busy reading through every piece of advice and faq i can find on this site
got all the spreadsheets ready as soon as i recieve my bank statements, thats if i ever do
im learning as i go, lesson number 1, always use recorded post.
we will soon see whether the cheque to them gets cashed,
Unfortunately i recieved a letter today from Alliance and Leicester acknowledging that they recieved my DPA SAR, however a cheque (apparently wasnt with it)
Even though i know for a fact it was, definately
A little annoyed but i guess its my fault for not sending it recorded delivery
Going to check the cheque hasnt been cashed, and then resend the letter with another cheque, recorded delivery, tomorrow
will recorded delivery make sure that the cheque arrives with the letter?
i presume if its recorded then theres no way they can throw the cheque away again when it gets there.
Ive heard about cases where even recorded delivery letters cause problems. i think special delivery is a better and more secure option, even if does cost abit more.
HMMMMMM alliance and leicester are very good at losing cheques hun they said first they had lost mine but miracles happen and all of sudden it was cashed! they like to be funny with your statements too and dont seem to like sending them until the very last day of the 40 or even 7 days later.
you will get them eventually.
OK so i sent off another copy of the S.A.R - (Subject access request) yesterday,
Sent it recorded delivery this time so (hopefully) they will definately find the attatched cheque
explained in the SAR that this was my second request and that i had already had to cancel one cheque.
included a photocopy of a pic of the cheque stapled to the letter, with the letter, just for good measure.
So now all i have to do is wait
On an aside, i have completely had enough of alliance and leicester, ive decided to change to Halifax, was this a good idea? i mainly did it as i am attending university in september and halifax offer a very good student account. Aswell as this, i would get an instant overdraft if i automatically transferred my existing current account to a current account with them. Had enough of getting consistantly overdrawn by a few pence every month, and being charged 50quid or so for it.
Thought this way it would also be much easier to calculate an up-to-date spreadsheet of all the charges, without having to update it every other week
Apparently got a large brown envelope waiting at home for me today
cant wait to see what it is
presuming its my backlog of statements
just gotta work through it all and see how much they owe me
will keep u all informed
xx
Ok heres an update
I worked out exactly how much they owe me £877.00, without interest
Last weekend i sent off the prelimary reproach, where i also stated that i was thinking about closing my account to avoid getting anymore fee's.
Got a letter a few days ago, saying that due to my recent correspondance they would close my account for me (how kind), which has ****ed me off, seeing as they didnt even mention the money
then today i got 2 letters through the post
typical fob off letters, first one saying that i am mistaken in thinking that claims can be made against anything other than credit card, lol
and then they sent me a letter saying that i should try looking after my aco**** better pretty much (not there exact words) just saying, use the online banking, take notice of how long cheques take to cash etc
anyway
so im moving onto the lba now
can i send this straight away, even though there is another 7 days before times up?
xx
hi, yes you can reclaim cost for postage but not yet, you'll have to wait till you made a claim in court, got it acknowledged by the defendant, received their defence.....anyway it would be at the stage where you have a court hearing with directions have to do COURT BUNDLE then you can claim for postage, ink, time spent doing the bundle at £9.25 per hr, travel expenses and so on. if its gets that far, dong go mad with the expenses!
heya
ok i got another letter off alliance and leicester again, saying that they were sorry to disappoint me again but i wouldnt be getting my money
do i have to wait for the full 14days after the lba straight away or can i continue now that theyve replied onto the next stage?
x
You should get something through the post from them in 3-4 days confirming that the claim's been issued and giving the date it's deemed served on the bank, you can also track this online.
After that it's down to the bank as to how they deal with the matter.
