Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I thought I should start my own thread here as I've just received my first letter back from the irrepressible Mr Beaumont.
I didn't bother with DPA as I just copy/pasted my last 6 years statements from HSBC online banking into Excel, then filtered out everything that wasn't a charge - total: £1312.50
Prelim letter sent 12th April, response received today - 21st April. Standard format, same as everyone elses (although I'm impressed that Phil manages to personally sign each one).
Thank you for your cordial response to my request for a refund of charges. However, I am disappointed that HSBC refuses to acknowledge that the charges levied are, in fact, illegal.
With this in mind, you leave me no choice but to inform you that I intend to bring this case to court unless I receive confirmation that you will refund monies taken from my account, without reservation.
I calculate that you have taken £1312.50 from me since May 2000.
I require repayment, in full, of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest, plus my costs, and without further notice.
HSBC certainly seem to be moving quicker these days. I've got my second reply back already, which means they must have sent it the same day they received my lba.
This one was from Allen Laidler (Service Quality Manager).
Should I now wait until the 14 days are up, or can I go straight into the claim because they have answered with their "final response with regard to this matter"?
I'd put the claim in, or you could wait for the complete time to elapse. Guess depends on how patient you are
I don't undertand the different reponses people are getting from different people at the Bank. I'm wondering, if it's under £1,000 they offer a partial settlement and then a full one if that is rejected? Otherwise there seems no logic behind the different responses.
Yep, they have acknowledged the claim today. One question though - the claim was not deemed to be served until tomorrow (3rd May), so is the 28 days from today or tomorrow?
