Got a bit of an update over the weekend. I received what seems to be two standard letters, one from The Woowich with the usual Blah blah blah and one from Barclays returning my cheque (thank you very much) and informing me that The Woolwich will be dealin with my request.
I wonder who paid for those letters (cause i'm not)!!!!!!
Just gotta sit back now and wait to see if they send them before my deadline or if they think i'm gonna wait for there (I don't think so!!!).
I've just been looking through the threads and templates trying to gain as much knowledge as i can for the next step. Can anyone tell me if there is a template for schedule of charges (not sure if i've missed it somewhere on the forum).

Well, i received my statements on Saturday and oh my god!!!!! have they really had all of that money off me????? £6301. I'm only just pickin myself up off the floor.
Anyway i'm gonna sort out my prelim letter and do the spreadsheet over the next couple of days and off we go!!!!!
I have just one question though. I beleive that the small claims if for £5000 and under. Now this might sound like a daft question but do i ask for £6301 and then if it gets to the court stage settle at £5000.

No, don't do that - you'd be letting them keep £1300 and we don't want that now do we . You have 2 choices:
1) Keep your claim just under £5000 using the OLDEST debt first. when settled you'd claim again for the newest debt of £1300 (plus any other potential charges accrued from then).
2) Fast track. The only real problem with this track is that you could be expected to cover costs should you lose. Of course this is highly unlikely but you won't have the security of the small claims track.
You could also claim your own expenses. I really don't know enough about it, so i'll have a look around for some links for you. You might want to go onto HMCS for reading.
If you choose to take the 'fast track' option (I would - but thats me) you will need to do alot more reading around the forums, and I will help you if you need it. What I should say though is there would be every chance your claim would still be allocated to the small claims track.
Have a read around, consider your options and there are plenty of people around to help if you get stuck
That amount is without interest. I took it from the statements they sent me. How naughty are they? Or do you think they were just helping me save for a rainy day?!! Well, its pouring down outside now and I WANT IT BACK!!!!!!!!!!
Anyway while i here i'll give a little update (not that there is much to tell). I haven't sent off my spreadsheet or prelim letter yet. I have decided to wait until after christmas because its been so manic and i want to start with a clear head so i don't miss my own deadlines.

Dont forget to that you can claim back all the interest that they have charged you on each of the charges from the moment they put them on your account.
Ring and ask them what the current rate of interest they are are charging you. this is the rate you work out what you are owed.
For instance a charge of £30 they made six years ago today, at 20.9% is now worth £105.87!

You calculate the total (charges + interest on the charges= total) This is your claim.
You write to the bank - "Give it it me back yer thieving rat bags"
If they dont you go to court with this figure as your claim, and you may now claim additional interest, at the rate you are being charged by the company, in my case 20.9%!
Its called Reciprocity of Contract.
In other words- what "They" can do to us- we can do to them!
Just about to start filling in my spreadsheet and have a question.
In the letter i received from the woolwich listing my back charges they have listed codes and charge type, see below:
RC Returned cheque
UC Unpaid direct debit
MC Unpaid standing order
OD Unauthorised daily overdraft fee
QC Guaranteed cheque charge
DC Debit Card Transaction
Can i put all of these on the spreadsheet?
I can't actually beleive that they have charged me £30 for each Debit Card transaction. How can they get away with that?
