    Default St Clair v Barclaycard

    Hi,

    After a successful result with claiming against the Halifaxicon on my wifes behalf I am now looking at doing it myself.

    I have received statements from Barclaycard, however they say that they can only provide them since May 2004, because the statements held prior to May 2004 have been Microfiche?

    The annoying thing is that I know most of my charges relate to a period prior to May 2004. Apart from paying the £3 per statement, is there a way round this?

    This is normal with B/C and until the Information Commisioner sorts out this problem as he did with the Abbeyicon B/C are digging their heels in.
    Write back to them stating the 40 days time limit still applies if they fail report them to the Information Commissioners Office you could also file a CC claim against them after the 40 days have expired.

    I believe you could claim the £3.00 charge p/statement back the same way as your £10 SARicon fee when you get to claim stage.

    I have been reading about estimating the bank charges.

    Currently since May 2004, I have got £220 in charges, so logically if I times this by 3 and get £660 this seems logical? I am certain it could be higher.

    Is there a letter template about estimating the charges beyond the period BC will not supply the information?

    The only problem with estimating is, if you underestimate then find out after you settle your estimate is hundreds of pounds out you cant claim again. its also risky because of the interesticon aspect and if your going to estimate its probably best to leave out the interest you cant accuratley work out. hope that makes sense

    okay, so the best route is to send a repsonse letter to them moaning about that they haven't complied with my request about the microfiche, etc. Is there a template letter I can use?
