I have just joined a gym with 3 months cancellation notice, however after change of heart have decided to join another.
Am I locked in, I cannot see anything in T&Cs about cooling off period, but only joined on 26th Nov.
Am I stuck in the contract for 3 months ?
It's hard without seeing the terms and conditions, but if you have had face to face dealings with the gym, ie went in there and signed up, then you have entered a legally binding contract and would be bound to give the required notice. They don't have to mention the lack of cancellation rights in the terms and conditions.
One thing I would say (and it's really a case of looking for loopholes here), gyms *can* be notorious for using unfair contract terms and it's really worth going through the terms and conditions of the contract to see if you can see anything untoward, or anything that puts the gym at an advantage over yourself (gives them more rights than you). Also, if you have signed a credit agreement for the membership, double check this and make sure they've laid out the amount borrowed, number of repayments, and that it's all been signed and properly executed.
Not looking good I'm afraid, but worth going through the terms just to see if you can see any loopholes that you can lean on. It's hard for me to go into any more detail without being able to see your paperwork though!
