    Red face Cosmos Won't Compensate!!!!!

    hi, am very new to this but wonder if anyone can help.

    i booked holidayicon accomodation through an agent of 'cosmos', i paid the full amount for a particular property as it had very good reviews and was adult friendly (ie no kids!!). i even spoke to an operator to confirm the booking was all in order (as we were travelling two days later)and we were told everything was ok.

    however on our arrival we were told, sorry but 'no room at the inn' and was directed to another hotel, which was just awful and not a atch on the one we had booked. at 1130pm there wasn't a great deal we could do and contacted the rep the next morning, who agreed to us moving to another property, but stated it was the only one left, we agreed to this as it was only marginally better that the place we were sent to, but were very unhappy and told the reps this, who advised to write in when we returned home.

    which is what i did, they responded stating an error was made on their part and sent me a £100 voucher - as if i am likely to book with them again. i responded to them and sent back their voucher, but now they are fobbing me off and its been nearly two months. i keep e-mailing them but i'm being told that the manager is dealing and she is currenlty off sickicon.

    is there anything else i can do???

    Hi mad chick,

    the Manager "is off sickicon" is not an excuse.... they have more than one manager in the head offices I'm sure, and I'm also sure that they can get another manager to deal with it.

    The best thing to do is to write a letter, telling them exactly what happened and exactly what you want them to do about it. Keep it short and to the point. Give them a timescale (beware, ABTA give them 28 days to respond) and if your requests are not met by your timescale, then you intend to seek legal advice. Advise them that this is your 2nd letter to them, and that you have been in touch with ABTA, (do this then you are not lying, not that they can do very much anyway, but they may point you in the right direction)

    Unfortunately there is no quick fix when sorting out these things, simply because of the timescales they are allowed to work to. They will try and fob you off all the way down the line. The trick is not to cave in and give up. The point is you booked a service and paid for it, and it was not delivered, for that you deserve to be compensated! They wont agree with you but do they ever.

    It took me 8 months to get my money back from a holidayicon company. As the previous poster states, write to them again, state clearly exactly what the problems were and how they affected you and your family. State what it is your looking for, there is no point in letting them offer you vouchers etc if that is not what you want. Be realistic in what you're seeking and give them a deadline ie 28 days to respond in a satisfactory manner. Let them know that after the dealine has passed you will be taking things further, possible going to the small claims court. I had to go to the small claims court with the company I dealt with but I won.

    Heidi is right - just to flesh it out a bit, the legislation you're looking at is the Package Travel, Package Holidays and Package Tours Regulations 1992. These will apply if you purchased the holidayicon as a whole package, to include two of the following three components: transport, overnight accommodation or other tourist services accounting for a significant proportion of the package (for example, excursions).

    Specifically, when it comes to performance of the contract, you're looking at Section 15 of these Regulations.

    There's a good chance if you arrange your flightsicon and hotel separately these Regulations may not apply, though - and instead you're looking at other laws such as basic contract law.

    hi we have had problems with a holidayicon company see my thread dirty accadation we did what you did we got letters of the reps took pictures etc they offered us £82 off our next holiday we said no after a few months i sent them a letter cut along story short i took it to the small claims courts who dealt with it today we were offered £430 pounds and £66 pounds for the taxis we had to pay out for
