Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Beginning to panic a bit
Received Woolwich court date for 4th Jan 07
Also received there defence, more than a bit concerned, 15 points raised can you tell me if this is a standard or computor generated letter.
It is a bit simualar to some of the threads ragarding that the charges have been applied to the account prior to 18th Sept 2000, but like you I know I have applied them correctly so not that concerned about that point.
Basically it says
Paragraph 1 "does not provide details or particulars of the account in question " ( what does this mean of course we did)
Paragraph 2 " if and to the extent it is alleged that the Claimants incurred bank charges on the account for unauthorised borrowings (whheather unpaid fees for returned cheques "Paid Referral Fees" or any other such fees), the defendant puts the Claimaint to strict proof or each charge and the date thereof ( do you understand this,? I have supplied then with all documentation etc and have followed all the correct procedures)
Paragrah 5 Goes on about the Defendants right to charge admin costs etc
Paragraph 10 It is therefore denied that the charges were unlawfully debited from the account
etc etc
little village in wales no point putting it here no-one would have heard of it

Re: Defence received from Woolwich
Hiya Lynn
Im claiming against the wooly and I suspect I'll get something like this through my letter box soon.
Its my thrid claim with various banks and its amazing how they all come up with the same thing time time and time agin!!
Ok first up dont panic - its nonsence!!!
Its just like the one Cobbetts send out for Natwest!!!
Like they going to say anything different "sorry your 'oner but we are allowed to steal customer money!!"
Dont worry about it for now there nothing for you too do, if the judge wants you to provide extra info then reply to him not these muppets!!! If youve done everything as laid out in this site then you got nowt to wrry about!!!
When the time comes just get your court bundle ready (not that you'll need it as they'll settle before then) but it doesnt hurt to familierise yourself with it.
Ive used mine in court now so I feel confident enough !!!
If you got any further quetions just let me know!!
