Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
thanks for this great site, i will be donating once i get my money back
Well here is my story
I came across this lovely site about 3 months ago and only recently finished reading a lot of the threads.
I wrote Natwest requesting they forward me my statements dating back 6 years. I received these and to my horror they sent mine along with someone elses. So i replied in my Prelim letter saying i was shocked and that i had lost faith in the bank if they could make errors such as this.
I calculated that i am owed £1300 from the last 6 years.
Anyway i received their reply just now. They said that they would look into the matter of the other NatWest customers statements. The also said that they would not be refunding any of the charges applied to my account.
I think the letter is pretty standard but i just wanted to know whether at this point other people had been offered partial refunds, as they haven't offered me a penny.
I was just going to send the lbabut i just wanted to make sure . You would think that as i returned 40 pages of statements belonging to someone else they would have at least offered me the price of postage
reading the other threads sometimes tou are offered a partial refund sometimes not ( didnt even acknowledge me) so send your lba with another copy of your schedule of charges

Sorry not good with PC's
Anyway let me fill you in
so far
1) i have received the statements along with someone elses can you believe it, 40 pages of them
2) sent Prelim letter, stating i am owed £1300 (with spreadsheet of charges). I also enclosed the 40 pages of additional statements and expressed my concern over their unacceptable error.
received response saying they would look into the matter of me receiving someone else statements, but would not be refunding any of my money, blah blah blah

Sounds like you've already done a lot before hitting this site ?? I would suggest you look around the Natwest forum, and Fid one of the Moderators that frequent your forum (Natwest), then send them a PM (private message), as it sounds like your at quite a critical stage, and could do with some guidance. Good luck !!
PS:
Check out this link to Financial Ombudsmans newsletter, some VERY positive comments about our cause, sounds like the big boys are statring to notice and get off the fence !!!

Don't do the interest until starting court proceedings.
They will probably send a "sorry you are not happy, but there is nothing further to add" letter.
At that point I sent the letter below:
Dear Sir
Thank you for your letter dated 16.11.06 from Mr. Stuart Higley.
It is clear from your letter that you are under the impression that I will not issue a claim against you for the return the unlawful bank charges debited from my account.
I am writing to inform you that this will be the next stage unless I receive full payment in the next 7 days of the £380 detailed in my previous letter to you.
However, please accept this correspondence in accordance with my duty under the Civil Procedure Rules to continue to pursue a settlement without the need to invoke the time of the courts
If you do not intend to defend your charges in court, but hoping that I will "just go away" I should to point out that this will not happen and you will incur further costs against you.
Take note that I will draw the Court’s attention to the fact that you have not made any attempts at settlement in accordance with the overriding objectives of CPR. Furthermore I will submit this letter to the Court as further evidence of your intransigence with my case despite my attempts at settlement and the settling by your company of all other similar claims to date.
Alternatively, in accordance with the overriding objectives of the Civil Procedure Rules I would like to give you the opportunity to settle this issue without the need to take the time of the Courts. My claim is for £380.00. If you could ensure that this sum is paid into my bank account within seven days I will inform the court that this matter is settled. If you wish to pursue this course of action please telephone me to obtain my account details.
Please do not waste any further time with something you do not intend to defend.
Yours sincerely
They paid out within 4 days of sending that!!!!
I think it was worth gambling 7 days.
